ladyarmani25 11-18-2003, 10:39 AM My boyfriend is currently in lakeview shock program. I just got off the phone with his counsler and she was like if he is not a american citizen he will be deported but hes been in there for about four months already and no one has presented him with any issue as far as him being deported. He's been here all his life both his parents are citizens. he is currently a permanent residence. I just want to prepare myself just in case anything does happen. I mean can they really deport him even if he knows no one in d.r. and his whole family as well as his kids are in the united states . Can someone please help........

bafriend 12-12-2003, 09:58 AM I know someone who was not a citizen...he was deported only after he served his 3 year sentence.

crystal&bo 12-15-2003, 01:38 AM I do not specifically know, but I talked to a girl at the county jail once while we were waiting for a visit. She said her boyfriend had been arrested before and not been deported (twice) but on his third charge it was a dif. city and they were going to. I think it sometimes depends on the city and the situation. Also I would think they would have to tell him.
ladyarmani25 12-15-2003, 06:08 PM well hes been in there for six months and comes home in june july and no one has ever told him anything yet i spoke with an attorney he said theres nothing that can be done we have to wait and see if they detain him he also said he wants 7500 if he does take the case and another 7500 if we have to appeal
Karl296 12-16-2003, 05:33 PM Last I heard, a resident alien will NOT be deported until his/her third non-violent felony conviction. Illegal aliens are deported as a matter of course in most areas, but I know of many in the lower Rio Grande valley of Texas that are not. I would not suggest alerting the INS by asking about your boyfriend's status. Just wait and see if they have a "hold" on him when he is due to be released. GOOD LUCK!

jreed 12-31-2003, 09:16 PM im not sure if anything has happened on this case yet but i have a good friend of mine who is from colombia. His brother dtated a girl underaged for 4yrs when they broke up her parents got him with some sex charge. well the judge made him think he was doing him a favor and gave him ten yrs paper and when he was done with his paper it would get taken off his record first offense it is for him but anyways 2yrs later just this past august ins went to his work picked him up and he is still sitting in the ins jail in st.petersbug. fl anyways my point i guess to all this is well he isnt an illegal immigrant but they are trying to send him back to panama which is where he lived after he left colombia and before he came to the u.s. i know that if it is a felony and they dont have green cards dont quote me on that just heard this from him they can and probally will if they have been convicted for a felony crime send them back. And his ins lawyer told us that if he takes it to trail and loses he cant come back here for 25yrs i dont want to scare u or anything but that is what is goinging on with my best friends brother right know in florida

I dont know all I can do is pray I guess because there are so many stories. INS just does what they feel like doing?
julie35 01-06-2004, 07:05 PM my brother first off is lpr since he was 3 years old , he is now 31 and they are trying to deport him. he has done his state time on a grand larceny charge of 18 months he was 7 months into his sentence before they placed a hold on him and when the placed a hold on him that stripped him of his m1 status and he was transferred to a medium security prison and served with a notice to appear before immigration.
well dec 1,2003 came his max out date and ins picked him up and took him to louisianna he is now in detention holding there yet to see a judge but that is all i can tell you as i am going through this immigration process myself.

bella 01-07-2004, 09:22 PM According to the 1996 laws INS considers a permanent legal resident deportable if they have committed an "aggrevated felony" HOWEVER, their version of an aggrevated felonies are charges that hold fines and nothing more in criminal court. I have never heard of the 3 time arrest issue. Unfortunately there is not much that you can do until the place a detainer on him and HOPE that they do not.
