Hi,

My husband is incarcerated for a crime he did not commit in the California Prison system. He volunteered to be sent out of state and currently is.

He has been told he will be transferred back to California because AFTER they sent him, they changed the rules regarding who can be sent out of state (based on no. of years sentenced). We don't want this to happen due to the hardship it would place on us because of the distance involved.

Does anyone have successful experience blocking a transfer?

Thanks,
Dawn

You might try contacting this person and explaining the circumstances:
Director of Adult Institutions – CDCR
Attn: Suzan Hubbard
1515 S Street, Suite 502
Sacramento CA 95814
FAX: 916-322-2877

I will warn you that no one at CDCR will listen about the fact that he is innocent. If he is convicted - he is guilty as far as they are concerned. So stick to the fact that it would cause undo hardship if he is transferred back to CA.

Good Luck

Hi Madhatter,

Thanks for the info. Haven't written Suzan Hubbard yet--will try that. I have been writing letters (and talking) to other appropriate people explaining that to transfer him back to California would create undue hardship. Please keep your fingers crossed that we are successful.
