View Full Version : Is anyone purposely violating supervised release?

A few years ago it was not uncommon for some to violate right away when beginning supervised release. At the time I believe the Guidelines called for approximately six months for something little like Not Reporting, but when that was done - no more supervised release and real life began again. I have a former cellie who is taking it to the door and now is getting short and wants to be done with it all as soon as possible.

My Sweetie has 3 years supervised release...he says that once he gets home and if he violates, he'll have to spend the rest locked up...then when he gets released again, he'll be totally free. I hope he doesn't violate, because I won't wait around any longer.

Waited over 6 years here so far...and have plans to be around another 9 years god willing! And thats nothing touching many of these woman...

But as for your post...never heard of it. Your saying if one has 5 years supervised released...if violated...they serve 6 months inside...then their hands were washed of everything?

The women here on PTO are very special. According to a DOJ study in the 1990's, only 5% of marriages/relationships survived sentences of 3 years or more.

Back to the subject: Several years ago --(the memory is less and less accurate as one's age increases :( )--

guys would pick some little violation like not reporting, not getting a job, etc, and then be sentenced for several months; the object being to be off paper as soon as possible. My first PO asked me the first day we met if I was going to violate to let him know as it would save him a ton of paperwork. I just don't recall the details of the process and would like to get accurate info to a friend.

I've never heard of such a thing unless it might be for people who only had six months left on their sentence anyway. As far as I know, you risk going back in to finish out your sentence.

You have to do the duration period locked up. A lot of folks seem to get 3 years supervised probation. Screw up, you do the 3. I know that to be true but because I just spoke with my lawyer about it. Doe's anyone know what happens if I screw up pre-trail probation during the self-surrender time. My lawyer doesn't seem to want to tell me that part, he just says "don't screw up."

Well, I'd guess you get thrown into jail and you get to sit there the rest of the time. If he just says "don't screw up", then I wouldn't screw up, if I were you.

Several years ago, if you violated supervised release, the judge could send you (back) to prison or reinstate, but NOT both.

That has been changed. Now you get to go to prison and then back on supervision.

import2121 - My husband done that (screwed up) quit reporting and dropped dirty. The federal marshalls come pick you up and you get to sit in county jail for about a month or more before being designated. If ya want to self surrender then he is right. Don't screw up.

My brother was out on bail, had a dirty drug test, they let it slide, had another, they arrested him and he spent the rest in county, could not self surrender.

Bail is not supervised release. Bail relates to pre-trial release/supervision, whereas Supervised Release is both post-trial/sentencing and post-incarceration. Supervised Release has a specific term and pre-trial supervision does not.

Don't know if this is right or not but my baby is in now for violating....original 7 yrs--did 2+ got out w/ 5yrs supervised. He was out for a little over 3 yrs and he got violated for not living at his approved home---now he's back. He says he'll be done when he get out. I hope he's right, but if not, I'd like to know that too!
