Can someone tell me anything about the criteria used for conversion of an inmate from old law sentence guide lines to new law in the state of Kansas? I do not even have a clue as to how to look for it or understand the sentence guideleines I did find myself. My email is doslobos63@hotmail.com
Thanks

Angela,
My bro said that his counsler told him the senate passed a new law pertaining to him, but hes not sure of what the law is. So hes taking it that new laws effect his lenght of sentencing, but they supposivly cant make him stay any longer. if you understand this you are doing better than me.

Hi Stacey,
Ks passed new sentencing guidelines in to take effect in July of 93.My Joseph missed them by a few weeks and is under old law.It requires a conversion through the courts to have your sentence converted to the new law with different guidelines. The new ones are generally shorter in duration of sentence than the old.Any new law in the senate that has to do with your brother's case, would have to be retroactive to some lenght of time to effect his sentence since he is already doing his time. You would have to know what the law is and how it could be applied to your brothers case.Joseph is going to have done 10 years by next june under old law sentence guidelines for something that only carries a three year sentence under new law and thus the court must decide if he is a worthy candidate for conversion to new law.If so he could be released and have no parole.
Find out what this new law is and I will look it up for you in the state legislature and try to tell you how it could apply.
I have had good luck dealing with the state Pd's they have been extrememly quick to respond to my emails with questions etc. I am in Minnesota and my hubby is now in Ohio and California is next. The ones I have spoke with got back to me within 24 hours. I found a list of them by state if anyone would like the link.
