I am and have been involved with a man with LWP in Michigan. I have so many questions, I guess I am looking for another view to balance what he has taught me about the laws.

His sentence is LWP. Now in Michigan, is this natural life? I am a little confused because i read a post that said that LOP in WI is 50 years. Does Michigan work like that?

So he and I are going to begin a money raising project. His mother said the origional trial only cost $3,000.00 for a murder trial. So the plan is to petition for a re-trail for a reduction of sentence.

It hurts, but i have to ask...how realistic is this? Or will I just find out these answers when the process starts? its been 4 years ticket free for him. I guess I just need support for what i feel in my heart, he will come home, one day :o(

I found the answer to this question that i asked a while back. Thought i would share the info:

Life Imprisonment - A mandatory term of life imprisonment without the possibility of parole must be imposed if an offender is convicted of First-Degree Murder or placing explosives with personal injury resulting. As long as the offender is serving a mandatory life sentence, the offender cannot be paroled unless the sentence is commuted or pardoned by the governor.
A second type of life sentence, from which a prisoner can be paroled, may be imposed for offenders convicted of life offense crimes other than Murder First or Placing Explosives and for habitual offenders. These cases are commonly referred to as "lifer law" cases. In such instances, the Parole Board can consider parole after ten calendar years where the offense occurred before Oct. 1, 1992, and if the sentencing or successor judge does not file written objections. When the offense occurred on or after Oct. 1, 1992, the board can consider parole after 15 years if the sentencing or successor judge does not file written objections.

my man is in mass w/ lwop.. and i still hold to hope
OUR main goal lately has been trying to get moved to a minimum but he has to stay ticket free,, and that can be very difficult!!

Donna i am in Michigan...unsure what Wisconsins are. I hear ya on the ticket free! 17 months ticket free, one ticket in 4 years and he gets a fighting ticket cuz he got hit coming down the stairs. Best of luck to ya, sorry i have no help for you.

I wrote a small note in the MI area ..asking info on similar things..
The man I am friends with has been in prison for 20 yrs.. ticket free (no trouble?)..not sure if it is LWOP or LWP... He is very excited, he seems to think he has a good chance of getting out.. cause his crime was his first offense..(yeah when he breaks the law he does it all the way)...I don't understand the Law at all..he is trying to explain best he can .... But thanks to your message here I now know what ticket free means..

so lifer law is only for people who did not commite murder then?
Now I wonder why my friend seems so sure he will get out , when in fact he is in on murder ...Wonder if I should mention this to him or let him think he will get out???

Okay I looked up my friends info .. he is in for murder first degree.. so thats not the same as LWOP?
In his info it says.. sentence- life

Strictlyred.. now life is not necessarily just for those who commit murder. Other crimes receive life sentences also.. even some drug offenders.

For guys like your penpal - who you know is my adopted brother - there IS HOPE and I know that this guy will never give up that hope... he won't allow himself to give up. I encourage him and will continue to do so until he tells me NOT to.

Michigan is currently looking at some lifers who have been in prison for a long time and are considering paroling them. Will they look at his case?? Who knows... but there always will be HOPE!

Yes, hope is very important for everyone, and I would like to personally thank you , Mrs.D, for helping me regarding your Adpt. brother.. he certainly is a sweetie..(don't tell him I said this)..I have been meeting many a--holes here on the outside..men who lie constantly..cannot be trusted.. then I find an honest supportive man..who is in prison for life... go figure..I was ready to give up on trusting men forever...
