MCBB1974 11-05-2003, 01:11 AM I was told that there was a bill passed that they can't hold inmates past thier time of release. For instance, if they are sentenced 2 years fixed but total sentence being 5 years that they have to release them at the 2 year point without haveing to go back in front of the board. Is this true? A friend of mine just went in front of the board in September and they denied him parole. His elig. date was in Jan. 2003. My fiancee is elig. December of 2003 and the board just gave him a 2008 hearing date. When I talked to friends and family a few weeks ago this is something they said they are working on. About the best we can hope for is they will have some idea where the bill is and when they think it will pass. If you have any other questions for me I will be happy to help you answer them. They said he was done on that day and could go home. He was out for 5 1/2 years prior to this. They atleast didn't take his street time. My guy went back on a violation, but they did take his street time away. You are very luck that they didn't do that. If they would have done that they could have added that 5 1/2 onto his Sept. 2004 date. Thats what they have done to us. We are trying to get that time back right now. MCBB1974 11-05-2003, 01:55 AM Im so sorry they did that. Yes we were very lucky he got his street time. Otherwise he would have had to do another 7 years. His total time was 10 years. He served 3 and was released in 1994. He went back 6 months ago. TNC 11-05-2003, 02:06 AM Did he have new charges? I know that right now they aren't sending many back for violations unless they are repeat violaters. The prison is so full and they dont want to let them out. Is his sentence satisfaction date Sep. 2004? If thats the case then he can probably file a SIPR now, but most of the time your first one is denied and you cant refile for another year. That would make it September of 2004 anyways. The best he may be able to do is wait another 4-6 months and file one and then since his time will be almost up anyways they may let him go. I know that would only get him out a few months sooner, but any time taken off is better then none at all. They are so full right now that people are getting away with violation after another because they dont have the room to house them. If fact people with drug offenses are getting probation instead of prison. Now they have your who only has a year left untill he tops out and they decide to go after him on violations that are over 10 years old. Thats crazy. I'm going to PM you some information. Part of it all was a set up by his ex wife MCBB1974 11-05-2003, 02:24 AM I was told that the are letting people out that they know will be back in a year or so and keeping the ones that they know won't come back because they make more money on they ones that keep coming back TNC 11-05-2003, 02:33 AM Knowing what I know now I can believe that in some ways, but in other ways it doesn't make sense. Now we have guys out there that are violating over and over and not caring about what happens or what could happen and they get chance after chance. The one thing I have learned with all this is that there is NO rhyme or reason to what the board does. You will never figure out their logic or reasoning on anything. I think they wake up one day and decide at that moment if they are going to keep guys in or let them out without ever looking at the files. They are very under qualified for what they are doing. |
