Does the court include "good time" when an appeal goes through and there is a sentence reduction or is it calculated seperately afterwards? Gino's appeal went through and he had 14 yrs to go and it's now down to 6 yrs. but his mom says the lawyer told he that gino could be paroled in 1 yr. so i wondered if that could have to do with "good time". He's been in 5 yrs. with little to no trouble.

No the court doesn't take good time or work time into consideration on a sentence. That is done by the prison system. That's why they are able to take good time/work time away for disciplanary reasons.

Mary, I can explain things better if you tell me

1. What is the new sentence, exactly, he was given by the
court.
2. How much time does he acctually have locked up on this
charge.
3. Is he eligible for all his credits, like good time/work time
etc.

With this info I can let you know how they will be calculating his time, with in a reasonable time frame. I wont have it down to the day, but I can give you a pretty close idea.

That's sweet of you to help me figure it out. I don't have the info. yet but as soon as Gino sends me the formal papers I'll look you up!
