I dont know if this post can help anybody. My husband is a US citizen, facing criminal proceedings in Australia. I am Australian, and so are my kids. I was afraid about deportation here. I contacted our US consulate here, that put me onto somebody in the United States. They said that if he was to get deported, that our family could fill out the paperwork and go back with him. She stated to me that it was upmost importance that I made my children US citizens, and if he is deported I could go back on a special visa with him, as himself and our three children would be US citizens, granting me residency. I dont know if any of this will help, but the other way around, it may be valueable information. So if you are overseas, and have a child to a US citizen facing prison time, go get them that social security number now.

Yes it is important and thank you for sharing this with us. The form needed is the N600, please fill it out, it is very important!

Thankyou Bella, I havent filled that out, but I did make my children US citizens, so now they have dual citizenship in the US and Australia. They have to chose by the time they are 21 apparently which citizenship to keep. ( I think thats how it was explained to me). I am going to call and ask about that form and me now, cause the kids and him can go back, Ill be devastated if I cant go with them.

If they are already citizens buy their father's status as you said you made them, you probably did file and N600 but I would inquire just to be sure

Actually, talk about things happening for a reason, I was meant to post here. I called the Consulate, and the only forms I filled out was registering my kids with the US consulate as being born overseas. She is sending me the details for me. Thankyou so much :)

My Fiance is an Australian citizen. He was born there, but came to the US at 2 months old. He grew up here, he's 100% AMERICAN!!!! He has no family or friends in Australia!!! He has a "potential" hold on him. I don't know what to think or how to react. The thought of him being deported, not knowing anyone, leaving me behind that breaks my heart!!! I don't know if I can go with him. I am a Native-Born US Citizen, but Most of my family is in Mexico. I have dual nationality. They wont give him a release date or any information!! I don't know what's going to happen. He's in Reception right now, so not talking to him for months is REALLY REALLY frustrating and depressing me!!!! I thought that mabey if I posted something here, someone else might have experienced this, or is going through it now!! Has anyone else gone through something like this?? How often do Australians get deported?? I know it's not NEARLY as much as Mexicans!!! Yup, that's why my family isn't here!!!!!! AAAAHHHHH!!! this is SSOOOOO FRUSTRATING!!!!!! GOD HELP ME!!!!!! I need my SANITY!!!!!!

Morticia, first off, calm down, and welcome to PTO.
My hubby is here in Australia, US born, and there not deporting him, even though it did worry me. Apparently there is some kind of agreement between our countries with a treaty or something. If its not a felony, such as a capital offense, you have not to much to worry about. THe US embassy told me this in Australia. I really doubt that they will deport him, even if they did, Australia isnt to bad , well sometimes :) :) :)

Update:

Well they put a hold on my fiance.:( So, after he finishes his time, they will send him to INS prison. :( I heard a rumor, that he will be sent to Washington D.C. Is this true? Is this where INS detention is for Australian Citizens?? HELP!! I'm so worried!!

hello ladies, well i will share some of my experience with you my brother is scheduled to serve his full time monday dec 2003 for state ,ins has a detainer lodged against him and i will let you know what happens when they pick him up ok.

How long was your fiance in prison before they put this hold on him? I am just wondering how long it takes for ins to put a hold on someone. My husband is in prison and we don't know if he will have a detainer put on him or not.
I don't know about the Washington D.C. thing....I wish I could help you out.

he was in county jail for 2 months, then in reception for 1 1/2 months. He was notified that he had a "potential" hold. When he went to his main prison, is when they told him, about 4 months after he was arrested. :(:(
