my boyfriend has been picked up on october 19, 2007, someone says if he hasn't got a parole hearing after 90 days he is automatically let out or something. and if it is true does the 90 days begins when they reach the pen or remand? thanks today is January 22, 2008 and he still doesn't have a parole date.

you should talk to a lawer you do not get released aft 90 days a bail hearing has to take place the courts want to know that you will appear in court and not flee the province if bail is not granted you sit in jail until your sentencing usually 2-4-5 mo.depending on backlog in courts. hope this helps.

it sounds like he was picked up on a parole violation, or at least, that's what his advice was for. Is a common mistake, usually by the other guys in remand with too much spare time and they all think they're lawyers. Courts don't assign parole hearings, the parole board does. If he was suspended, the board has 90 days to make a decision, not necessarily a hearing, on whether to cancel the suspension or revoke parole. The decision can and is usually made without a hearing required -if a hearing is required, he could be waiting right up to the end.

The 90 starts when he gets to the pen... before that, he could stay up to 30 days in Remand (but I heard cases of guys that were in Remand for 2... and some guys stay 30 days in Remand and they're PO sends them back to the Half-way house where they were staying at before being picked up and sent to Remand)...
