I have a few questions that I hope some of you can help me with. My brother was suppose to be paroled next week to a half-way house. Well they just informed him that with a federal detainer he can not go. He is awaiting deportation. He is a UK citizan. My question is how long can the prision hold him for waiting for INS. Also after he is transfered to a federal prision how long on average to they hold you before they send you back to your country?
I've tried calling lawyers and of course they want like a thousand dollars just to talk to him. Of course I don't want to pay the money if they are just going to turn around and tell him you have no chance! If anyone can help me I would be so greatful. He has served just about 7 years of a 10 year sentence. He was charged with strict libility for a drug induced death. He has been in this country since he was three and has no family in Scotland. I am a citizan and so is my sister. Our parents passed away a few years ago. Thanks for the help.

Perhaps I can be of some help. You said your brother was getting out on parole, so the prison can hold him up to the entire length of his original sentence.

For the federal detainer info, I have no idea how that works. Perhaps Bella can be of some assistance as she has been through the INS ordeal. Feel free to contact her by private message if you like.

I hope you get the info you need and if you'd like to give your brother a little extra 'family' this year, please add him to our Christmas list and he'll receive greetings and wishes from all over. The member BSS is in charge of this.

The Feds can hold a person that is awaiting deportation by the INS indefinitely.
