I have a few questions that I hope some of you can help me with. My brother was suppose to be paroled next week to a half-way house. Well they just informed him that with a federal detainer he can not go. He is awaiting deportation. He is a UK citizan. My question is how long can the prision hold him for waiting for INS. Also after he is transfered to a federal prision how long on average to they hold you before they send you back to your country?
I've tried calling lawyers and of course they want like a thousand dollars just to talk to him. Of course I don't want to pay the money if they are just going to turn around and tell him you have no chance! If anyone can help me I would be so greatful. He has served just about 7 years of a 10 year sentence. He was charged with strict libility for a drug induced death. He has been in this country since he was three and has no family in Scotland. I am a citizan and so is my sister. Our parents passed away a few years ago. Thanks for the help.

I would call a local legal aid agency and inquire, he may have a hardship case and may not. As for holding him they cannot hold him indefinatlety but if he is going to fight the deportation it could take months. If he agrees to it once there is a finial order of deportation it should only take a few weeks to send him back to his country.

I HAVE A BROTHER IN THE SAME SITUATION AS YOURS HE IS SCEDULED TO GET OUT OF PRISON IN DECEMBER AND TO GO TO A FEDERAL HOLDING PLACE ALSO. MY BROTHER IS FROM SCOTLAND ALSO AND HE HAS A FEDERAL DETAINER ON HIM. HE HAS BEEN SERVED WITH A NOTICE TO APPEAR AFTER HIS CRIMNAL SENTENCE IS UP AND THE I THINK HE WILL BE DEPORTED . I HAVE CHECKED INTO EVERYTHING THERE IS NO RELIEF FOR SOMEONE WHO IS CLASSIFIED AS BEING AN AGGREVATED FELON.
I AM KINDA OF IN THE SAME BOAT AS YOU AND I LOVE MY BROTHER AND TO BE SEPERATED FROM HIM WOULD JUST KILL ME. SORRY I COULD NOT HELP. WELL WHAT STATE ARE YOU IN OR WE CAN TALK ON THE PHONE BYE AND GOOD LUCK.

My brother is scheduled to be moved on Thurs. to the halfway house. However with the detainer I don't think he will be going. I've been reading up on benifits in Scotland and such for him. Where abouts in Scotland is your family from? What prision is your brother in now? At least he can always go to Canada and I can visit him there. Keep me posted on how your brother does. Ha cannot go to Canada for 5 years after his release. Please look into this before making any plans

Thanks for letting me know but after reading into Canada I later found the whole 5 year thing out. I wonder if it is still 5 years even if they don't consider my brothers offence a crime. My brother is in for Strict Libility for a drug induced death. His girlfriend died. I've looked through all of the law books and can't seem to find any law of it's kind in Canada. I know it is not a crime in Scotland because I have family over there and they looked into it for me. If anyone knows anything let me know. Thanks.

HE IS IN SC RIGHT NOW I WILL LET YOU KNOW WHAT HAPPENS ON DECEMBER 01,2003 WHEN HE GETS OUT . I FEEL LIKE MY WHOLE WORLD IS CAVING IN ON ME. WE ARE FROM ADROSSAN SCOTLAND NEAR STEVENSTON AND SALCOATS. STEVE WILL BE REALLY LOST IF HE GETS DEPORTED BACK THERE HE HAS NOT BEEN THERE SINCE HE WAS 3 YEARS OLD.
ANDER LET ME KNOW OR BELLA LET ME KNOW IF THERE IS A WAITING PERIOD TO FLY OUT FROM THE UK TO ANOTHER COUNTRY AND CANADA OR MEXICO IS THE ONLY CLOSEST THING TO UNITED STATES. KEEP ME INFORMED LOTS OF LUCK ANDER.

My brother is still in detention awaiting his hearing. I am hoping that his passport comes through soon. If your brother doesn't have one it's best to get those things in order before he is going through all this. The goverment gives a temp. one but the british goverment takes it upon arrival. well good to hear from you again. do you know for sure he is going or not and what kind of travel documents do i need to get as far as his birth certificate he does not know where it is so i guess i will have to write away for that. also i don't know the first thing about passports. stacey do you get to talk to him by phone or do u have to communicate through letters and how
