I would really appreciate if someone can help me on this:

My husband is sentenced 30 months.he is in Millhaven now still in assesment unit.His PO said he will be send to fenbrook.My husband finds out from other inmates there is atleast 40 people waiting to go there ?
ques 1) How long is he looking to go there?

he was recommended the violence prog.his 1st day parole hearing is april 15 and the PO returned his application back to him and told him to give it to new place he goes !at this rate will he ever get a chance to his 1st let alone 2nd hearing in Aug 2008.
I have hired a lawyer to appeal his sentence and he hasn't filed anything yet.Should I be hiring a parole lawyer ?does anyone know a good one in Toronto?

His current employer b4 he went to prison still wants to hire him when he comes out.does this help ?

Hi, I'll tell you what I know. First if your at Millhaven the assesment takes about 8 to 12 weeks, once thats done they assign you to your mother intitution. When you get to your mother intitution is another story, right now from what I understand there is a little over crowding going on, so it will depend on how much of a turn around is on right now. As soon as he gets to his mother insitution, he will be assigned a P.O. and the two of them will get a correctional plan drawn up; what programs he must take (they may be needed before he gets parole), if he'll go to school or work while inside, his release plan. Having a job lined up is really good, it shows that he has stability on the outside. Lastly his parole hearing, wether he will have the support of the P.O. for parole. Make sure he applies for parole, don't wave it, even if the P.O. dosen't support him, go for it anyway, he'll be able to apply again sooner if something changes. If he waves it, he will have to wait six months before the next one. For parole get a parole lawyer to speak on his behalf at the hearing, the best ones are based in Kingston, have him ask around.

One thing, if he's on appeal, it might be more difficult to get parole, not unlikely, just a little harder. This is because the board wants to hear that you have taken responablity for your actions and are ready to change. If your still on appeal then it dosen't look like your ready. But like I said, you never know what might happen and the boards are very unperdictable.

some good advice...i'm in the prairies so maybe things are different, but the other PO told him to hold off on the application because of the transfer and the support issues mentioned above. If he had put in the application before talking to his new PO, he may have found out there's some changes that needed to happen and no time to fix them. Because of the time (30 months), there's some time before anyone will WANT to look at him, so find out what he's doing in the mean time (working, programs)...be worried if he's doing nothing while he waits.

Once again, this may be a location issue, but I have yet to meet a lawyer that knows anything substantial about corrections or parole. Unless he's being deported, be highly cautious if a lawyer offers to help on parole issues -it is not like a court system, there is no rescheduling and you as a family/friend/whatever have more say towards parole than a lawyer.

Speaking from personal experience....I put off my parole hearing because I realized that I was not going to have completed my mandated program by the time of my parole hearing. I knew that without proof of successful completion of my program, my parole chances were minimal and I would have to wait 6 months before I could even apply for another parole hearing.
6 weeks after my program ended, my PO had squeezed in a new parole hearing for me and I was successful. So, cancelling my parole hearing worked in my situation.
