I can't get anyone in charge to answer my questions so I thought I'd give you great folks a try :)
My husband was sentenced a year ago in Tulsa to 18 years. He's now at Lawton Correctional Facility. He was granted a Judicial Review for this Thursday morning under his sentencing judge here in Tulsa.
Here's my questions.....
Will he be at the hearing? The DOC info site says he will be. He's being told (by other inmates) that Lawton will charge him $300 for transportation and that they will take it out of his account until it's paid in full. Is that right?
DOC also says I can have court clothes brought for him to change into but noone will tell me where to bring them.
Final question. We don't think there is any chance of him walking out of that courtroom a free man (and we're ok with that), but we want to know if his time gets reduced will he still be transported back to Lawton and his same pod? Or will he go back through LARC.
If anyone's gone through this and has info it would be appreciated. Post here, PM me, or email me. I'll be offline this evening but will check back in overnight.

I am not sure about all of the questions but the clothes would have to be taken to the jail he is at. I don't think they can charge you for the transportation to the review but hey this is klahoma we are talking about I will make a couple of calls tomorrow and see what I can find out for you if you like.

Thanks MommaHen :) If the clothes need to go to Lawton then I don't have a chance anyway. It's a full days trip for me and I can't make it tomorrow. We found out about this hearing last week and that's how long I've been calling trying to get them to answer me. So I guess it's blue scrubs for him. But I will be at the hearing and I'll have a bag of clothes waiting in the car just in case :)

Well, I went to court this morning, but my husband didn't. Lawton forgot to bring him. Never mind that I left messages on his case managers machine for almost 2 weeks straight, somehow they still forgot.
But that's ok. They changed the review date to Nov 10. And, I was finally able to get our lawyer to answer questions for me. He thinks it looks really good that the judge will reduce his 18 year sentence to around 3 (enough time to complete the sex offender program). That's great news to me !!!! I'm not going out and booking us a cruise yet, but I have hope that he'll be home in enough time for me to laugh at him when he starts going bald :D
To those that helped and kept my spirits high, thank you so much. I'll let you know the next date outcome....unless Lawton forgets again :argh

Have his lawyer call before the next date at least a week in advance, and trust me the judge will not be pleased with DOC if they forget again. try to get them to move him a day or so before the hearing they can house them at the county jail there or at least that is how Oklahoma county does it.

Hi, my name is Carrie. My father is currently serving time with a judicial review. As far as Lawton bringing him here...it doesn't happen like that. It would be Tulsa County Sheriff and their extraditions department that would have to bring him in.
Has your attorney in the case filed a writ of habeus corpus?
It's needed to transport any prisoner.
Also, if you call the sheriff's office, after a writ of habeus corpus is granted, they will get things done a lot faster.
You would need to talk to a woman named Melissa, who is in charge of all the extraditions.
My father had a writ to go back to his doc facility after going to tulsa for another case...he was there forever. Finally, I called Melissa to ask her what was going on with that.
She told me "he probably hasn't been taken because I wasn't told he needed to be." So...a couple days later...he was back at his yard. Melissa is real nice too...leave her a message if she doesn't answer...she is one of the few that will call you back.

Our lawyer has a nasty habit of NEVER returning my calls. And of course, he's never available when I call. He's handling this pro bono this time and he's our only hope so I don't want to tick him off. But, I will send him a registered letter with your ideas included. At least then I'll know he had every chance possible if he's forgetting some steps with this review.
I also plan on sending a registered letter to my husband's case manager & warden advising them of the upcoming court date. That way they can't say they didn't know.
As you can see, we are kinda stuck. The lawyer won't answer my calls and the DOC people are never available. So letters will have to do for now. My husband is going to talk to his case manager this week so hopefully when I visit him Saturday he'll have some info.
