Hi everyone......I just wanted to share my good news. My husband received a break in his sentence. Instead of 12 years in and 8 suspended...the judge modified his sentence to 4 years in with 16 suspended. He will now only have a 5 year sentence left to do on a A&B on a police officer. This is not aggravated so he is considered non-violent. (this charge is in the process of appeal)
How long does it take a prisoner to come up for parole on a 5 year sentence? He has good time and he is getting 3 for 1 being a level 4 w/ enhanced time. DOC has not calculated his time yet.....we just received the Order October 17th.
If any of you know what I am looking at now with a 5 year sentence...please tell me. I get so confused on this time stuff.

Amy it depends on if he is under the truth and sentencing law...but the way it sounds he isnt which means he is under the old law which means he should come up for parole in 18 months...but not everyone makes parole their first time or second time up.
Congrats on the good news tho. Hope the information was helpful....my hubby has been in since 1994 on his third time down so i am kinda used the system...plus i have a friend with experience also. Hope it was helpful to you.

Ok most all of themm have to do at least a 1/3 of there sentence before they come up for parole so 18-24 months will be abput right for the first parole hearing. Best of Luck Hun!!!

Thanks for the information everyone. According to our attorney he has been in long enough to either discharge out or parole out on the 4 year sentence....then he will begin his 5 year sentence. I talked to him last night and he said that to discharge out it would be about 18 to 20 months. We are not sure when a new parole date will be set. When he had the 17 years on him...he was to come up for parole in 2006. He has as of right now 2000 days left with this new modification. I tell you what this DOC stuff is crazy. But I feel so blessed to receive this modification!!! There is a light at the end of this awful journey. I just recently lost my dad to cancer on Oct 7th and this news really picked my spirits back up.
I will be praying for your husband's review freckledgrl and I will be praying for all also!!!

He was sentenced by the old law. He does not have to do 85% of his time. He is a level 4 receiving the enhanced time. So that is 3 for 1 right now.
There is a guy that is in with my husband and it is his second time in and he had over 5000 days left and he came up for parole and they paroled him to the streets......CAN YOU BELIEVE THAT?? But I looked it up and it is true. So all things are posssible.
My husband said that he has 4 months left on this 4 year sentence before he can start the 5 year....so I don't know if they will put him on the parole docket or not. They may just let him go ahead and discharge on the 4 year sentence and let him roll on in to the 5 year sentence.
Boy what a mess :)

Are they running Cc or back to back if they are back to back he will go right into the 5 year and it will take about 18 months to do that sentence then parole if they are running CC then he will be eligible in no time.

How did he get a modification? Was it with an Attorney? I can't afford one but would love for my Skunk to get a reduction on his sentence. His controlling charge is Eluding and he is doing an 8 on it. Any help would be greatly appreciated. Thank You
