No, the fact remains that he assulted you. Whether or not you were under the influence is irrelevant.

The state or city should be picking up the charge, and your condition would be of no import. You will be subpoenaed to testify, which you SHOULD be straight for. Go for it! That kind of relationship is never good.

That you were impaired does not invalidate the report and it's really out of your hands- the worst thing that can possibly happen is that his attorney may try to use that to discredit you, but that won't have much impact if the police report reflects that your statement was credible.

i know it won't make any difference to the district attorney's office. the only advice i can give you is try not to get on the bad side of the DA. i did and it only made things much worse. and be really carefull if you have any contact, i'm sure the court has a no contact order. APD will be checking up on him and will be more than happy to take him back to jail and give him new charges if you two are together!
