My step-son is in a military prison, or so I am told. The reason was because when you sign up you have to sign a form stating that you have no knowledge of a crime, or knowledge of an injustice, or some such thing, and they just found out that he did and he had been. 17 yrs ago he testified against his own dad knowing that he was innocent of all charges because his mom and stepdad forced him too. Now it is all coming out and they arrested him.
Can this be true? I have no knowledge of Military law whatsoever so I have no idea if this is plausible or not.
Can someone help me? It is driving me crazy not knowing if it is true or not. One reliable source, one not so reliable told me JAG had him. One not so reliable told me why.
Any input would be appreciated.
thanks

funny face,
Welcome to PTO. You have come to the right place as without this site I don't know if I would have survived it all.
As for the military justice system I can only say "anthings possible".

Sherrie,
Your post presents an unusual scenario, that's for sure! It sounds like the issue is whether your stepson provided false information on his application to enlist. I'm not sure what the charge would be under UCMJ (I'll have to do some research on that), or whether providing false testimony in a court proceeding 17 years ago is still a chargeable offense (there may be a statute of limitations in that state that prohibits the filing of charges at this late date). Your best source of information at this point is your stepson. Do you know which facility he is being held in? Try contacting the unit he was assigned to for information regarding his whereabouts. If that does not help, contact the Trial Defense Counsel office at the base where he was stationed. Even if they are not involved in the case (i.e., he has hired a civilian attorney), they may be able to provide you some information as to how to contact him (or his attorney). I hope that you find out something soon and I hope this info may point you in the right direction and at least give you a start. Good luck!
~Lisa.

Thank you both for your reponses.
the problem is I have never met my stepson, don't know where he is and have no info on him at all. I was just informed by 2 people that JAG had arrested him and why.
The crime was 17 yrs ago, but it is now in the process of overturning the verdict because his sister came forward and talked about the set up. He did not. He was also asked in 2002 if he would come forward, and he said no, he didn't want to bother at the time. That is all on paper. So, all I was told was you sign a paper when you sign up for the military and since he lied on that paper about his part in this 'crime', he is now paying the price for it.
I just needed to know if it was possible and if the Military did things like this after all this time, or even if it mattered to them.
I guess I will have to just wait and see....
thanks for all your help.
