I am writing because of my Father. In 2005, he shot and killed his wife of 6 Mos. He has been an undiagnosed paranoid schizophrenic for as long as I can remember. He divorced my Mom after 30 years of marriage, saying that she was poisoning him. Only to disappear, and reappear, 3 years later. He had married and divorced another woman, saying that she had poisoned him. When he reappeared, he sought me out and lived with me and my husband for about 6 mos. During that time he also accused my husband of poisoning him and tampering with his computer. He has basically accused everyone but me. He even went so far as to threaten my sister with her life.

Now, here comes the real problem. The daughter of the victim just wanted to settle things and for my Dad to admit guilt. She said a 5 year plea of guilty would do. My Dad accepted this plea and will now be out in 2010. My entire family is terrified. He was found incompetent many, many times during his incarceration. Any advice how I can have him permanetly "put away" after his release? He's already up for parole in Feb. of 2008 because of time served. Our entire family (and his) are writing letters to the parole board in opposition to his release.

Anyway, if you have any experience with this or any ideas, please post.

Thanks,
Laura:confused:

You're going to have to have him declared incompetent by reason of mental defect. Or whatever way your state phrases it. You will have to have a hearing before a judge, and someone will probably have to be appointed as his official, legal caretaker, and ask for him to be committed post-incarceration. It may not actually be worth doing until somewhere near his release, but it's worth doing the research on it now. Interview a couple of lawyers about their takes on it.
