Hello everyone, I have a son who is HolmesCI, in June he received aCC for trash under bunk the trash was dust, he got no gain time for June, I wrote to MC Donough in tallahassee and asked questions , my son asked for an informal grievance, long story short , the request just dissappeared,I have since received letters from the Inspector General and the Region One office , I have as yet to be told what was done about these things,all the letters were is a bunch of crap and run arounds, what do you all think I should do, or is this a dead end? Atleast they know that my son has someone out here who does care about him and I will continue to be there for him.

My fiance only stayed at Holmes for a few days while in transit to his new facility, but he nicknamed it "Camp of a Thousand Rules." He said he got in trouble for everything (very, very minor things) while there, though was never written up. I would continue to follow up on the disappearance of his grievance. Because most people give up is why they continue to get away with the things they do. Good luck!

Okay, I can help a little here. According to Chapter 33 the grievances are supposed to be placed in a LOCKED box and very few (sepcifically named) people have key, none of which are security staff. Once these grievances get logged in is where the difference takes place...
Informals - must be addressed to the person directly responsible for the issue being grieved. Grieving gain time should go to the OIC for the officer/sgt who rated it for security gain time or to the Supervisor if it was work gain time - if it is a compaint about staff it should always go to the OIC or Colonel - never directly to the staff member. It is the OIC's/Colonels responsibility to conduct the investigation and seek a resolution or explain why something was done the way it was.
AT our institution, we have told all Captain's that is is their responsibility to review and investigate all informal grievances routed to them, once responded to they are supposed to be returned to the grievance coordinator for logging out and then sent on to the griever. So, here the staff member does know a grievance has been written, but they do not have access to "get rid of" the grievance.
Formal grievances are logged, the appropriate person is contacted usually by phone and asked about the situation (a lot of times we do not even have to mention the specific inmates name) - if needed the grievance is copied and sent to the OIC for investigation and a response is required to be returned to the grievance office within 5 days(so it can be investgiated further if needed). Once everything is done it is returned to the griever.
I still have inmates submitting grievance through routine institutional mail. Yes, the officers pick up, distribute and re distribute this mail. They can pull stuff out and do whatever with it. Does it happen? I cannot say it does or does not - I have never personally witnessed it.
The locked box system is there to make sure the grievances get where they are going. Someone mentioned grievance are not numbered - no, not from the factory, it would be too difficult to keep up with the numberings needed for each of the institutions. Each institution is required to maintain their own numbering system for informals and formals sent directly to Central Office. The institutional formals are entered into a database that automatically generate a number and a receipt.
Tell your loved ones to be sure to put their grievances in the LOCK GRIEVANCE BOX. There should be one available in a general population area (most of the time in the dining hall) and one is supposed to be taken around daily in confinement. If their institution does not have a lcok box system, call the grievance coordinator (may have to go through wardens office to find out who this is, some places have a person whose title is grievance coordinator but at most places it is the Assistant Warden for Programs.) and ask why they are not using a lock box grievance system as required by chapter 33. Again, use honey instead of vinegar. Mention something like you were concerned because your loved one mentioned they do have a lock box system for grievances and he/she has some concerns that his/her grievances have not been getting thorough. They do not have to know your loved ones name and if they insist tell them it is not important as this is a rule that is supposed to be applicable to ALL insitutions and thosed housed in them, if they insist, just tell them thank you for your time but I believe I will contact Mr. Whitehurst or Mr. Mcdonough and see if they can assist me as I don't fell the name is necessary for you to deal with this issue.



Also on gain time - some are under the impression that just by showing up for work everyday they should automatically receive Above Sat ratings. sorry but this is not so. They also believe you must receive a CC or contact card notation to be rated satisfactory. Again, not so. In chapter 33 security and work evaluations are based on a number of observations. Now to give an unsatisfactory or above satisfactory rating, a comment is required as to why this rating was given. No justification is required for a satisfactory rating. Satisfactory rating = the basic gain time they are eligible for above sat rating = additional award to basic GT. Again, some think the above sat award if the award they are entitled to and are "losing" days if they get a satisfactory - technically they are not losing any days, just not being awarded the additional days. We do adjust gain time ratings all the time - inmates will go to the officer who rated them and (without attitude) ask why they were rated as they were, what did he/she do to cause the lower rating, calmly and rationally expalin the situation. Now you wold have to see the gain time rating sheets to understand how easy it is to make an error they print is miniscule and is crammed together like sardines - if you have a log list to rate, your eyes can go crossed and mistakes can be made. Normally if an inmates asks the officer either explains the reason or realizes a mistake was made and initiates the paperwork to fix the error.
Also, please remind your loved ones, they do not have to file an informal grievance to dispute gain time - they have a limited amount of time to file a gain time grievance - if they file an informal that will delay it up to 10 days, assuming the person responds within timelines. Gain time is posted the 15th of each month, grievances must be filed by the end of the same month - filing an informal just lost 10 days of the remaining month. Gain time grievances should be filed directly to the warden on a DC1-303. First, I would recommend they talk to the rating officer as stated above then also state in the grievance that they have done this and what the outcome was of the conversation.
