My boyfriend sent me a letter about 2 weeks ago telling me that he got a letter from the parole board saying that he is granted parole and he has a F1 status. Well he got a major case a while ago and that changed his line class to a line 2. He told me that he probably wouldnt get parole (this was before the letter) because you cant get granted parole on a line 2. Is this true?? If so, how long would it be before the parole board will tell me something, because I called last week to Austin and Huntsville and they told me that nothing was in the computer yet. Any help would be appreciated.

If he got dropped to LC II in the period of time between the IPO interview and the Board vote, the FI-1 decision will be returned to the Board by Releasing with the disciplinary as new information. Similarly, if the action occurred after the Board vote and computer input by RRP, it would probably be picked up in Records and they would return the file to Releasing with the question.

Given that one must be at least at the entry status before a Board-voted release to parole, the FI-1 will in all likelihood be rescinded with a NR date at least one year down the road, with the next review actually being contingent on regaining entry level status (Line Class 1 for all who entered on or after April 01, 1995, State Approved Trusty Class IV prior to that date).

One thing to keep in mind...is that the Texas Board of Pardons & Paroles doesn't actually APPROVE the parole...they RECOMMEND or FI vote it.....FI stands for further investigation. (for precisely the reason you describe....if victims or cases come up).....like Lyn indicated, the vote can then be reversed.

What unit is he in? Have you contacted the unit for more information? Is it the Huntsville board? Have you contacted the board directly?

We'll assume the worst, but hope for the best till we can find out more information......that way....we are prepared. Let us know how we can help!

Actually, the FI designators are holdover terms from several years ago. The Board is tasked by Government Code with the approval of the release. However, there are several steps to process the file from Board vote to the release from the facility. One of the stops in the process of proc'ing someone entails checking disciplinary and then Records tends to do the same thing before penciling the actual release date and giving the certificate back to the Parole Division. It was also at the Records level that you sometimes see ID protest the release if someone is in AdSeg (doesn't happen near as much as it used to but it still happens as a way to jack with someone's vote and release to supervision).

Neither the Parole Division nor the Institutional Division have a final say in whether the release is approved- it all falls upon the Board (hence the political nature of the process since they are appointees).
