Of course, there has to be a LEGAL basis for the appeal. A lot of people get confused about appeals because they think that the appeals court will look at 'right and wrong'...not so. They look at the process by which the case was decided. The decision is secondary to the procedure. And a trial atty is not necessarily well-suited as an appeals atty since a trial atty is more about right and wrong and convincing a jury of YOUR peers. Whereas an appeals atty understands that the appeals court justices are not going to be persuaded by a friendly demeanor and a nice smile. They just want the facts of how the case was decided. Right and wrong only play a role in the process of the trial...not the decision itself. Bottom line, yes, people win appeals and sometimes it is very surprising WHAT can win one. --cessna ForeverJosette 09-07-2007, 09:20 AM Cessna, was wondering about the appeals you were talking about. My friend that is in Cummins has filed an appeal if he wins the appeal does that mean he can possibly come home real soon? I was also wondering how long does it take for an appeal? FYI... just an update for you all... he LOST his appeal and will be going to serve time in prison for about 8 mos. or so. Please keep us in your thoughts and prayers. Thank you. |
