YES: This directive makes sure cases are based upon facts and limits individual prosecutors from cutting special deals.
PRO: Ashcroft is making sure the Justice Department can prevent seriously lenient practices by federal prosecutors and judges. He said federal prosecutors should seek charges “for the most serious, readily provable offense” supported by the facts of the case.

NO: Gerald Lefcourt, former president of the National Association of Criminal Defense Lawyers, said Ashcroft is just "adding more unfairness to the system."
CON: Lefcourt said, “This is taking discretion away from the U.S. attorneys’ office.” He continued, “prosecutors on the ground who are most involved in the facts of the cases should be making these decisions. It shouldn’t be dictated to them.”

My take on the guy is that he is still obsessed with being beat out in an election by a dead guy and is making the rest of the nation pay for his own embarrassment

I agree. Ashcroft does need to go somewhere else. He is just making the system even more unfair than it already is. HE wants to put all the people who makes mistakes in jail, eventually we will run out of room. I wonder where he will put them all, in his office with him.

I'm against plea bargains because they coherce innocent people into admitting crimes they did not do, and they do not give the victim justice in cases where a serious crime did happen. However, I doubt that Asscroft has false-accused people in mind. He just wants to control everything - the judical system, DAs, public defenders. I think the only way to maintain fairness is by dealing with crime on a case-by-case basis rather than so-called blanket solutions.

Screw Ascroft and anythings he says just because of who he is and what he stands for. God sits on high and look down low. He'll have his day soon enough. :argh

I think more cases should go to trial. These prosecutors have too much power to pick and choose who will get what. It's unfair the way the system is, I see too much disparity in sentencing. However, I don't think this is the way to go either.
