Hello all I was just released from The Ft. Sill RCF on April 6th So if any body has any questions about what it is like there so they know about what their sons and family are going through please ask. I Was sentanced to 4 years of comfinement and served 22 months. And then released on parole. I noticed a commpom question on this board was weather or not your charges go on you civilan record once you are convicted...Well here is what i was able to find out according to a "person with athority in the RCF" "Your charges will not be realsed to the public athoritys un less form XXX is signed by person XXX, In most cases this form never gets filled out or seen unless you are convicted of a expically heinous crime (any sexual related offenses except cheating on your spouse ect...) And expecially violent crimes where it is mandatory. Person xxx can choose to fill out this form though if they want your record to follow you. Here is the kicker though you will never see this form and you have no legal right to request to see it.(Never contacted an attorney though because i was told what mine said.) Well i am open to answer any further questions. And if you were or know some one that is/was incarcerated from AUG 23 05 to April 6th 07 please say hi as there are some dear freinds that were and still are there that i would love to be able to get in touch with. (Unfortuneantly they took all my contact information before i walked out the door.)

My best wishes to anyone and every one that has some one incarcerated in any millitary prison and i will do my best to help them if i can.

Fin, Welcome to the forum! Congrats on making parole and being released. Thank you for your offer of information and support. It's always nice to hear from those who have "been there, done that." Keep posting!

Fin83, any word on whether the Commanding General is lenient on granting clemency?

It is not up to the commander of the facility to grant clemency. The inmate appears before a Board who forwards a recommendation to the Army Clemeny and Parole Board who makes the final decision.

Thanks for the update. I guess I'm still a little confused on the whole clemency thing. The General at the post my husband was stationed at denied his clemency and his lawyer did say that would be the case . And now we are trying to get together character reference letters, residency letters, employment letters...to submit to someone, not sure who, this is where I get confused. My husband said he "heard" the general at Ft Sill was lenient about granting clemency.

The general at Ft. Sill very very rarely grants clemancy. I am sorry to be the bearer of bad news. He doesnt even usually see the clemancy letters the SJA (Staff Judge Advocate) usually makes a recomendation and the gen just signs (although it is one of his assistant cronies not actually him unless it is approved.) If you could mabey tell me a little more i might be able to give you a better idea. Dont know how to get a hold privately on here if you dont want post it. Let me know how.

I am soory if i wasnt encourageing...I wont give out any false hope there is too much of that in the system. Jusat keep your head on straight for you spouse and yourself. I will provide any advice/help i can.

I gurantee you that your UCMJ conviction is in the FBI's NCIC computer, which any law enforcement officer can access, though a background check from a agency doing background checks for employment purposes will come up with nothing.

My son is incarcerated at Manheim - Germany. I am interested to to hear what it is like behind bars in military.

Hello and welcome to PTO and the Military Justice forum. I'm sorry to hear your son is being held at Mannheim. My son was there for about 8 months awaiting disposition of his case and he didn't have a lot good to say. But then, it isn't supposed to be a vacation at Disneyland. I don't know of any particulars other than it's old and the plumbing isn't the greatest. And it is SO FAR AWAY! I sent my son phone cards while he was there so he could call. For the most part, being incarcerated in a military facility is no different than state or federal facilities. There are some differences because of military regulations but that is particular to each facility. I think they are safer in a military prison due to less gang activity and closer supervision. My son is at USDB now and I don't think I've had a single fear for his personal safety in the entire 6 years he's been confined. If he were in a state or federal pen, I'd be scared all the time!

Those of us who have been travelling this road are here to help you find answers to your questions, so feel free to ask. We're also here to listen and provide support and encouragement. The military justice system can be very formidable and confusing. A lot of information is already available in the postings on the forum but if you have specific questions you cannot find answers for, just ask! Someone will answer! Keep strong and keep the faith!

Thanks, for answering. All this is new to me and it is hard being 4000 miles away and not being able to offer any type of help. His request for clemency/reduction in sentencing will be held in a few days but we are not getting our hopes up.
