View Full Version : visitation rights for father in prison???
my fiance has a 10 year old son but he hasn`t seen him in 6 years and misses him so much. the mother of his son (they were never married) doesn`t want her son to be in contact with his dad and that`s why she refuses to go to the prison with his son. does anyone of you know if my man has visitation rights or what we could do to make something positive happen in this situation? any help and information would be appreciated! does anyone know where i can find a good website regarding this topic ? toi_ama 09-24-2003, 11:14 AM Since they were never married, that could present a problem. Was paternity established and was child support ordered? If so, he probably would be entitled to visitation, although I don't know if she could be required to take the child to prison to see him. I don't think so.
If paternity wasn't established and no child support was ordered, then he probably doesn't have visitation rights without a court battle.
The best thing for him to do is to just write to her and see if he can negotiate some contact with his son. At least maybe he can establish some mail contact with him.
thank you toi-ama for your reply. my man writes his son on a regular basis but his mother never allows him to read or see the letters,so he basically knows nothing about his father...they have already gone through negotiations and such but she doesn`t want her son to get to know his father...
they were never married so i guess this is going to be a problem...one more question though...my fiance`s grandmother is the only person out of his family that his son is in contact with. does she have the right to take him to the prison or introduce him to his father?
toi_ama 09-24-2003, 12:46 PM I don't think the grandmother could do that without risking the mother cutting her contact with the boy, too. Maybe if your son were to send letters to the grandmother for the boy, though, at least he could have his letters read to the boy by the grandmother. Of course, though, then that would also get back to the boy's mom and she could keep him from the grandmother, too. It's always so sad when parents use the kids as pawns.
mlle_keiko 04-16-2004, 07:26 AM Ummm..not sure if this is relevant, but in NJ the grandparent's have "visitation rights" with the grandchildren. I know this because my friend's daughter's exboyfriend's mother took her to court for "grandparent's rights" for visitations with my friend's daughter and won. SO if things ever got down to this lady not letting the grandmom see her grandson, there is this law, but I'm not sure if it's in all states.

I have paper work that can get most vistation rights back to them, how ever, i have to see if this is included with those that were not married. I will get back with you on this.

I went through the court on behalf of my husband and filed for visitation rights...guess who is ORDERED to take her 2 times a year. Don't worry about him not being able to appear or fight his own battle incourt, he can get what is called an order to appear telephonically, which means the DOC is ordered to let him call in for that court hearing. Let me know if you want more help! Dont give up hope someone cares!

my son is going through the same thing with his ex-girlfriend. she took his daughter off of his visitation list. i was told today, that she (ex), is the only one that can put his daughter back on the list and she has to go through the whole process again of getting approved. this is in Florida. i am trying to find out what i can do to rectify this situation. :help: my son only has 16 more months before he gets out and i want to get the ball rolling. i know it will be hard for him to get custody or even joint custody, but whatever i can do now to help make it a little easier. any suggestions would be appreciated.

I'm tired of her holding our granddaughter over our heads so she thinks she can pull all this stuff and we won't do anything in fear that she'll keep her from us.:mad:
