I have a step-son that has 2 children with this woman...they were living together for 5 years and they are splitting up. He is coming to Texas because he has no other support in Phoenix. What I need to know is this:
1. How does he go about receiving Visitation Rights in the Courts?
2. How does his mother go about receiving Grandparents Visitation Rights?
Any info would be greatly appreciated
The "Grandmother" is my wife and this is my step-son and we live in Texas.
Thx.

They have a self-service office at the Superior Court in Phoenix. He can go fill out the forms, and pay the filing fees. It's pretty self explantory. He can go online and download the forms at Maricopa County Superior Court that's assuming he lives in this County. If not he needs to got to the Court in the County in which he resides. Also, If your son is going for visitation and he is on good terms with his mother the courts will expect your son to share his visits with his family when he has the child. So if that's the case tell your wife not to waste her time. Good Luck.

Arizona does not recognize common law marriages.

Yes, the Maricopa Superior Court Self Service website can assist you. Since they are not married, there is a packet called establishing cusody and child support and things like that, there is also instructions with them. It's pretty simple and as long as he is not a drug addict or involved with crime, he should be able to gain joint custody or at least have regular parenting time with his children. Good luck! I also am a paralegal student and am finshing up my Family Law class as we speak, so if you have any further questions, please feel free to PM me.
