Alright all, what happened to me yesterday with Juan has spurned me into something that is just amazing. I have gotten in contact and involved with an immigration rights group and am starting a petition to enact a new law for INS detainees rights. In order for me to do this, I will need stories. ANYONE who has someone involved with INS, being detained etc......I would like to have your story. I need the following information:
Detainee Name
A#
Location being held
Story of immigration
Story of detention and what they are being detained for.
Story of family members
There are new laws being introduced that could help these people from being deported. Here are just a few that are being introduced that could affect a lot of people:
H.R. 1452 – Family Reunification of 2001 (Rep. Barney Frank, D-MA)
Makes people convicted of aggravated felonies who are sentenced to less than 5 years eligible for cancellation of removal
Eliminates the clock-stopping rule, except for people who do not attend their hearings
Allows discretionary release from detention if the LPR is eligible
Allows people to apply for the relief available at the time of the offense
Allows those who have already been deported to reapply for relief if they become eligible under this bill
Restore Fleuti doctrine, which allows LPRs who leave the country for short trips to not be denied admission upon reentry.
H.R. 500 – U.S. Employee, Family Unity and Legalization Act (Rep. Luis Gutierrez, D-IL)
Bans retroactivity for LPRs who committed a deportable offense prior to April 1, 1997 (this extends St. Cyr coverage to those without a guilty plea)
Allows release of detained LPRs who have committed an aggravated felony if they cannot be removed, or do not pose a danger and are not a flight risk
Prevents retroactive application of the new definition of aggravated felony
Redefines a crime of moral turpitude as a crime committed within 5 years of admission for which an immigrant serves more than 1 year in prison
Bars characterizing a crime as an aggravated felony if the underlying conviction is a misdemeanor or has a sentence of less than one year
H.R. 171 – Fairness to Veterans Act of 2001 (Rep. Jose Serrano, D-NY)
Amends the INA to make veterans of the US Army eligible for discretionary relief from detention, deportation, exclusion, and removal, and for other purposes.
H.R. S.955 – (Sen. Edward Kennedy)
A major overhaul of the 1996 immigration laws. Amends INA restrictions respecting: (1) cancellation of removal; (2) deportability and admissibility; (3) judicial review; (4) right to counsel; (5) detention; (6) applicants for admission; (7) removal of aliens who are not permanent residents and who have no relief from removal; (8) reopening of certain proceedings and parole of certain aliens; and (9) aliens who have made false citizenship claims or who have unlawfully voted
I know this is a long post....but hopefully it will help some people. If you know of ANYONE in denention, or your spouse who is in jail/prison knows people, have them get their stories and send it to you, then on to me at my E-mail.....jayllon@kscable.com
