:confused: O.K. Here is the deal---I called the parole OMBUDSMAN this morning and was told that Damein's parole is in the "review process". IF??? he is granted "mandatory supervision" he WILL get out on his short-way date which is Oct.15,2003. My next question is this---What exactly does "mandatory supervision" mean? I was under the assumption that ALL parole was "mandatory". Any help will be appreciated. I am in a frenzy and need to make some plans for his release such as picking him up!!! It is ALL SO confusing!!! Thanx!!!

I sent this to you PM....and I've posted the HB1433 info all over the Texas forum, but some of that stuff gets buried, and I felt like others may benefit from this....

FIRST OFF, PAROLE IS A PRIVILGE, NOT A GUARANTEE.

For offenses prior to 1996, if the good/work/flat time = the length of the sentence, TDCJ was required to let an offender go. They saw they were releasing all kinds of offenders and in 1996, they changed the law that said this mandatory release was still looked at, but offenders were released at the DISCRETION of the board still (Discretionary Mandatory Supervision is now what it's called).

He has about a 50/50 chance to shortway (they release about 25% on 1st review, 50-60% on mandatory).

According to Tx Govt. Code Ann. § 508.149(b)(Vernon 1998). an inmate eligible for mandatory supervision is released unless the parole panel determines that the accrued good conduct time is not an accurate reflection of the inmate's potential for rehabilitation and the inmate's release would endanger the public.
