Just thought I'd update you on our wonderful justice system that canada is so proud of
As you know I haven't had trailers in six months because the last one we were in for only one hour when security come in with the dog and found pills in a first aid box which they tried to charge Rick with. They were not ours of course and we suspect that they were planted there by security because of the way the whole thing went down.
Well, Tuesday my husband finally had his day in court and we were worried because it has taken so long that they would just throw it out of court but no, we went to trial. AND my husband WAS FOUND NOT GUILTY! Thank goodness justice prevailed in that case.They refused to do fingerprinting or anything that would have proven at the time that the drugs were not ours.
But we had our day in court and God is on my side.
Well since then he was called for a urinalysis for drugs....a random thing that happens. When it does he has to cathetorize himself to get the urine. He had kidney stones and it wrecked something or other but he has a hard time peeing on demand. Anyway, to make a long story short the plan with security for the past while has been that when his name comes up for random urinalysis the guard stands outside his room while he does the business. (In the normal procedure the inmate is behind a screen in the office of the urinalysis guard and pees into the bottle) This procedure was agreed upon by my husband and security staff. However this time the guard along with a female guard insisted on watching him cathetorize himself and produce the sample. He refused of course. Female guards aren't even allowed to strip search inmates so I don't know what was going on there.
My husband got in touch with his lawyer and a big human rights issue came up. There was a meeting with the warden and security and oh my goodness the stuff really hit the fan. The guards were severely reprimanded, he actually got an apology (first time ever) and assurances that it would never happen again.
The very next day he called his lawyer to let him know what happened and found out that his lawyers name had been taken off of his phone list. Inmates cannot call anyone not on their list. It won't connect through. It is their legal right to always have access to their lawyer. So....my husband goes up to the Visiting department who is in charge of the phones conincidently. The Bitch said I didn't remove the number when he asked her. He said well the numbers are only done through this office. She said she would look into it but didn't have time right then. So he asked to use one of the lawyer phones in the office. She said No...you have to fill in a request and I don't have time to give you one. So he said isn't it convenient that I was found not guilty this week for a charge that came from this department and now my lawyers phone number goes missing off my list. I think I will make my lawyers phone call from the wardens office.
Well, the warden freaked...called V&C and told them he wanted no more problems with this inmate and that they had five minutes to get the lawyers number back on the list.
Can you see the bull that they are putting him through? Just because he is due for parole. As long as there are charges happening he can't apply. Thats why the drugs were planted. I don't know what to do.....if this is ever going to stop. The lawyer is suggesting harrassment charges against the prison and if we do that it has to stop because it will just add to our case.
