I have a few questions, and need help. i am not new to the TDCJ system-but things change everyday! My husband is on 2 probations 2nd degrees one is defered and the other is straight. One is agg assult with deadly weapon from 1996. The other burglery of hab from 1999. :mad: Now he went to SAFP for violating his first charge by catching the second charge. He completed it and was released to a half way house in Austin. Then he was suppose to complete a full year of after care. He got out of the half way house and moved in with me. He was going to after care for a few months and then he missed a few. I was pregnant at the time and was at the hospitial for a few of the times he missed. Then all together he stopped going. Then he came up dirty for weed in a ua and then amitted he dirty for a ua in another and did not get tested but had to sign a papper. He is also behind on his fee's. SO now in the DA's office are three revications. 1. dirty ua 2.not paying his dues 3. not completing his aftercare program. I would like to know a few things since the agg asult was caught in 1996 if he got his 10 yrs will it fall under the new law or old how much of his time will he have to serve on that? Will it be 80 or what is the old law, 50? Now since they cut the SAFP program to 6 months only how long is the relapse program for? He is still free with his warrents and working- we are trying to get a lawyer to set bond on the warrents before he has to go to see his PO on the 17th of September. Any suggestions on what to do? We have a new baby and he is the only one working I can not bare the thought of him getting his time and need help. Thank you................................. :confused:

You can find out most of your questions on the TDCJ website. It lists old law years and new law years, meaning what percentage of time he may have to do. Also it may be different if the case he is sentenced for is aggravated. My man violated probation also and was sentenced to Safp in the mid 90's. After the halfway house in Austin he violated again and in June of last year sent to TDC for the rest of his sentence. His crime was commited in '88 (old Law) non agg and he only had to complete 25% of his time before parole eligibility. Hope this helps. I will try to seardh TDC for you also.

My husband and I went through a similar situation where he violated probation and everyone including his attorney thought they would make him serve 5 years in TDC. I found out who the judge was over his case and I wrote the judge a very nice letter explaining everything to him. That my husband was working to support our family and that I was preg. The judge ended up telling the DA he wasnt going to send him to jail and he better find another solution they did.
Another 2 years probation, they lowered his fees from 40 a month to 5 a month and they told him to go to school.
Maybe you should write a letter once it gets court date and ask that he be sent to a drug reham or something.

I would never recommend writing to a Judge. It may have helped in one case, but 99% of the time it just goes in the trash. It could also hurt his case if the Judge is an a**. Just be careful!! He will probably have to do the new law time, but I would check the TDC website just to make sure. Here's the link for ya:

Well his judge is the bigest a** in the world. The da won't do a bond because the po wants to revoke him. He is mine and our 2 month old daughters only means of life. We are doing every thing we can to keep him out here with us as long as we can and if he does have to go back I want to be prepared for how long it will be!:confused: :cuffs:
