I understand once out on probation and for another 20
years the Fed takes and ordered REstitution.

I also understand that they allow you to support your family by paying living expenses,
but is it true that any income bEYOND SURVIVAL Income
is required to pay for Restitution...i.e. say you make $30k a year to survive, but one year you make $60k...does that mean the Feds Take the extra $30k to pay for restitution
or do they do it by a percentage factor.??

hey restittution is only when you owe money to some one, like if it was a bank robbery , or if you stole merchandise or any thing that envolves cost... so if you dont owe the goverment nothing when crime was commited you wont have to pay restitution.... my man's lawyer told us that...

That's true, but the fines that the court can impose can be quite hefty. If you look over the charging documents (indictment) where it shows the separate counts, it will say punishable by "xyz" years imprisonment and a fine of up to "xyz" dollars. I know i'm facing 1.5 million if fines and my charges are drug related. I believe if they fine you at sentencing it will end up being broke down into a payment plan.

Yes it will be broken down. Billy was only fined $100 because his charge was non-violent, non-drug related and didn't have a victim. However, the judge sentenced him to 65 months. They took the fine out of his prison account in payments.

Import, yes it will most likely be interest free and be able to make payments. While you are serving your sentence you will make payments based on how much money you get monthly. If your family sends in money monthly, you can count on some of it being used as restitution. They usually will impose a fine big enough that it carries past your sentence so that once you are out you will have to make payments while still under the courts jurisdiction.

Not true.. They can impose millions in fines and make you pay all of it.

I was in half way house with an older guy that had $11 million! in restitution and fines for his hand in a drug conspiracy. He did around 5 years. He'll never be able to pay that off.. He was no investment banker or anything like that..
The restitution varies by case. There is a ceiling they take, if memory serves correct. You won't be stuck with X number of dollars a month and all the rest being handed over to the feds..
