MY SON CALLED LAST NIGHT TO TELL US HE GOT A CALL FROM HIS APEAL JAG IN DC. SHE INFORMED HIM THAT HIS APEAL HAD BEEN PROCESSED AND HE WAS GIVEN A REDUCTION IN HIS SENTENCE OF ONE YEAR AND A REDUCTION IN THE TYPE OF DISCHARGE TO BAD CONDUCT INSTEAD OF DISHONARABLE. I AM SO HAPPY FOR HIM (AND ME TOO!) NOW LET'S SEE WHAT HAPPENS IN DC AS HE STILL HAS HIS PAROLE HEARING ON DEC. 20 TH. I DON'T EVEN KNOW IF THEY WILL HAVE THE HEARING AS IT LOOKS LIKE HE WOULD BE OUT SOONER WITH THE 1 YEAR REDUCTION THAN ANYTHING THEY COULD DO.

He thinks it will be late Feb. or early March, I guess the brig has to calculate his release date. He was arrested on the 4th of Nov. 2003 but I'm not sure how the good days add up on a 5 yr. sentence. He also lost some of them about 18 months back. I guess it is just a waiting game now. :D:D:D:D:D

well, that is just awesome, you all must be so excited!! I hope it is sooner rather than later.
i dont really know about the good time either. i think it goes by what you have served of the sentence, but i could be wrong. i had thought there was a 10 day/month good time, and if he was sentenced before the end of 2004, then he would get that rate. now i think it has changed to 5 days/month. then you add in any extra time for work, minus any loss for mishaps and it looks like a calculus equation!
Anyway, you can at least plan and celebrate and get him some goodies. im so happy for your family. A good waiting game this time!! :)

He was sentenced in April of 04 and that sounds about right. I don't know what is going to happen with his parole hearing in DC., anyone have any Idea? That is on the 20th of this month and I was wondering if that will still happen.

does anybody know where I am suppose to go for the hearing in DC/VA? my son's parole hearing is going to be either the 1st Thursday in Feb or March ( they haven't finalized the schedule yet) and I want to get an idea of where I am going before hand.

well, i couldnt remember what branch he was in, but i found these 2 addresses, maybe one can give you the correct info. im not sure if these are addresses where you would go or not. i had also though there was something in VA, so im confused.

Just an update:
OK, so back in November our boy got 1 year of clemency (taking his sentence to 5 yrs not 6). anyway he was still waiting on the deciion in D.C. re: his recient parole hearing in witch he requested 1 yr. of clemency or parole and was approved @ the brig level by ALL mambers of the board. He got word on the decision in DC and they denied him on the clemency and on the parole saying this: minimum senetece not served. Although this doesn't matter cause he will be home this spring it is a example of how our military justice system is so flawed. He has now served 3 yrs and 2.5 months of a 6 yr. sentence and then was given a reduction of 1 yr bringing it to a 5 yr. sentence.
Last year we watched as the sargent involved (w/a 5 yr pta) was granted parole after serving only 2 yrs,) I just don't get it! Gar, Gar!
