I AM ASSUMING MY BROTHER WILL BE DEPORTED . HE WAS IN ONE PRISON NOW THEY MOVED HIM TO A MORE SECURE ONE. WHERE HE IS LOCKED UP ALL DAY I GUESS BUT I GUESS SOMEONE FROM INS IS GONNA VISIT WITH HIM OR SERVE PAPERS.
MY QUESTION IS THIS WITH HIM BEING ALREADY LOCKED UP AND ONLY HAVING A FEW MONTHS LEFT TO DO WILL HE BE ABLE TO GET OUT TO GET AN ATTORNEY OR SHOULD I GET ONE BUT I DON'T KNOW WHAT IS GOING ON AND GETTING NO ANSWERS AT ALL.

UNDER THE IMMIGRATION LAW HE IS DEPORTABLE BUT WILL THAY DEPORT HIM I HAVE NO CLUE. IF ANYONE CAN RELATE PLEASE PM ME OR SUBMIT A REPLY. THANKS

They cannot hold him indefinately. In other words there is a strong possibility that they will release him but not right away. It may take months and some fighting. They may then release him while he fights his deportation case.

I APPRECIATE ALL YOUR HELP IN THIS. I DID SPEAK WITH MY BROTHER AND HE SAID HE HAS NOT TALKED TO ANYONE YET. HE SAID IT IS ROUTINE FOR INS TO QUESTION ALL ILLEGAL AND LEGAL ALLIENS IN STATE CUSTODY. YOU KNOW I THINK HE THINKS HE HAS NOTHING TO WORRY ABOUT I HOPE SO. BELLA DO THEY DEPORT ALL CRIMNAL ALLIENS OR JUST SOME . WHAT HE DID WAS VIOLATE HIS PAROLE ON A GRAND LARCENY CHARGE AND GOT 18 MONTHS BUT ONLY DOING 9 MONTHS . ANY INFO WOULD HELP THANKS AGAIN

I cannot answer that truthfully. I have seen some people be released however more often than not (since the 1996 laws went into effect) they are detained by INS. I guess it just depends on his case and the INS agent who determines it. He is right, it is common for an agent to come talk to a permanent resident or illegal alien, they have been making this routine for quite a while.
I wish I had a more positive answer for you but all I can say is that you will have to wait and see.

well thanks bella for answering my post well my brother was visited at the state jail where he is doing time. the ins gave him an notice to appear for court upon his release dec 2003 . hopefully they won't come get him. if he does try to fight his deportation being a lpr for 30 years will he have to be detained or will he get a bond.

do you know if they have no representation going in court that they are sure to be deported or can they talk on there behalf. my brother does have hardship if the judge would grant it. he has two american sons and 1 is deceased i just feel if the little boys dads get deported it would just devestate him. thanks julie
