i am heading to federal prison and my wife is right in the middle of adjusting status to permanent residence. the bcis(ins) knows i am in trouble already because the feds told them. i dropped her off back in the philippines on a travel permit to wait for me there until i get out and then petition her again. we are married already by the way. i saw something about if the US citizen has a criminal record they wont let her back into the country. is that for real?? in that case we would never be able to see eachother for 3 more years or whatever my supervised release would be. if anyone knows about this, please post or pm me!!!

WOW..I'm really not sure about this at all. Please complete a search on this topic and let us know if you get any info. If not please let me know and I will see if I can find anything out for you. I have never heard of this being an issue since you are a citizen correct?

Yeah, I am a US born citizen and my wife is a Filipina national. I did not think the criminal history of the petitioner would be an issue either until I saw someone mention that one guy could not get his fiancee into the US just because he had a DUI!! What if you have a bank fraud charge?? It would be incrediblly cruel if on top of a prison term they will never let me see my wife again. I am waiting until tomrorrow so I can call the BCIS and ask them about this. I am hoping this is just misinformation!!

I was under the impression that it was only the criminal record of the person who is planning on moving to USA. I understand your pain by the way. If you look at the newsgroup alt.visa.us.marriage-based you will find a wealth of information. The people there seem very knowledgeable.
