My son has been at DVI since mid September. He is due to be released in early December and still has NOT seen a counselor or gotten his release date. It is now going to be under 30 days before his release and they have NOT asked him to have dress out's sent in. Wha't going on is this place? Do they release inmates out of DVI with only a couple of days notice and no dress outs?? I just don't know what to think. I can't even visit because my son forgot to sign the visit form and he had to send me and new one which has NOT been approved yet and it's been a month now. This is SO frustrating!!! Help!!!:mad:

HI - my son is at DVI also. I know it is hard to get any information about what is going on. I live in Michigan so I can't visit. My son will be there until July 2007. That's good news that your son is being released. Is he on the Ranch there or in the main? I can find a number for you to call about parole if you would like it. I talked to someone there a few weeks ago.

My son is NOT on the ranch or in the main. He is in reception. He has never seen a counselor at all yet. Once he does it is possible that he gets transfered to ANOTHER prison even though he is scheduled to be released in early December......LESS THAN 30 DAYS TO GO!!!!! He needs to be seen and given a release date or Transfered....but if they transfer him now there is not time to process him in a new orientaton section at the new prison. They were supposed to assigned him to a counselor, met with him, given him a release date and a letter stating to send in his dress outs (which he would then send to me) and NONE of this has happened. He feels they have forgotten about his, except they sent him to medical when he got really sick, and that he is never getting out. THey will not give out info over the phone. :confused:

HAVE U TRIED CALLING??? I SUGGEST CALLING THE PRISON AND ASK FOR THE COUNSELOR ON THE RECEPTION YARD. BE AS NICE AS UR CAN BE(IF NOT NICER) EXPLAIN U R HIS MOTHER AND THE SITUATION ASK IF THEY CAN PLEASE TELL U WHEN HE IS SCHEDULED TO SEE THE COUNSELOR. THEY WILL NOT GIVE U ANY RELEASE INFO BUT I HAVE CLD TO THE PRISON MY HUBBYS AT WHEN HE FIRST GOT THERE AND THE COUNSELOR WAS VERY NICE I KNEW WHEN HE WAS SCHEDULED TO GO TO CLASSIFICATION, WHEN HIS COUNSELOR WOULD SEE HIM B4 HE HIMSELF EVEN KNEW. HIS RELEASE DATE SHOUD NOT BE EFFECTED EVEN THOUGH HE IS STILL IN RECEIVING!! DRESS-OUTS, IN CHINO MY HUBBY JUST GOT THE DRESS-OUT FORM FROM A C/O SIGNED IT HAD THE C/O SIGN IT AND THAT WAS IT!!! THEY DID NOT EVEN VERIFY HIS REL DATE THEY JUST GAVE IT TO HIM. I AM NOT SURE IF DVI IS THE SAME BUT TELL HIM TO TRY. I GUESS IT JUST DEPENDS ON WHO U GET ON THE PHONE AND WHAT KIND OF A MOOD THEY R IN AS TO WHAT INFO THEY'LL GIVE UP. My son has been incarcerated since September 2005. He was scheduled for release in June but only days before his release another county suddenly decided he had some old charges that had never been addressed. They picked him up and he spent 3 months in county before being re-sentenced for another eight months. He got straight time for the county time and half time for the state time so I am guessing he gets out in early December but so far nobody has told him anything. He has a whole box of dress out clothes back at Soledad but they will not send them over because he was technically "paroled" while he sat in jail at county. Now, everything he had at Soledad is just sitting there and he will only be able to get any of it after he is released and sends for it. So.......I am not putting together ANOTHER box dress outs but DVI has never sent my son to see any counselor (he has been there just under 2 months now) and he does not have the form he needs to send to me for the dress outs. I called today and actually got through to the visiting line!! I tried to make an appointment to visit my son but they told me I was not approved yet. :(

I AM SORRY BUT I AM NOT UNDERSTANDING THIS PROPERLY. I AM GETTING THROWN OFF HERE BECUZ THE COURT'S DO NOT SENTENCE YOU FOR 8 MONTHS IN PRISON. THE MIN. SENTENCE THE JUDGES HAND OUT FOR STATE PRISON IS 16 MONTHS!! IF HE GOT 8 MNTHS THEN THAT SOUNDS LIKE A PAROLE VIOLATION BUT THAT DOES NOT MAKE SENSE EITHER. ARE U SURE HE DID NOT GET 16 MONTHS W/ 1/2 TIME WHICH WOULD BE WHERE THE 8 MONTHS COMES FROM??? ALSO WHAT COUNTY JAIL WAS HE IN??? IN COUNTY JAIL U DO NOT DO STRAIGHT TIME. AS FAR AS I KNOW (AT LEAST IN LA, OC) YOU GET GOOD TIME WORK TIME CREDITS AT 2/3 TIME. FOR EXAMPLE IF HE GOT 90 DAYS COUNTY TIME HE WOULD ACTUALLY SRVE 60 DAYS.. IF HE WAS SENTENCED B4 A JUDGE AND LETS SAY HE HAD 30 DAYS ALREADY IN CUST. THE JUDGE WOULD GIVE HIM CREDITS FOR ACTUAL TIME SERVED AND THEN ADD THE GOOD TIME WORK TIM CREDITS AS WELL SO HE WOULD GET A TOTAL OF 40 DAYS CREDIT..(AM I MAKING SENSE???) NOW ABOUT HIS PAROLE CLOTHES JUST ARE U THE ONE THAT MAILED THEM TO HIM?? IF SO TRY CALLING THE YARD HE WAS ON AND LOCATING THE CLOTHES EXPLain to them that HE WAS SUPPOSED TO PAROLE AND DID NOT!!! TELL THEM WHERE HE IS AND ASK THEM TO RETURN THE CLOTHES TO U!!!! I DON'T KNOW WHY THEY Always make such a big deal overt nothing. di du try calling the counselor 2day??? that would be ur best bet... did ur son mention to u if he was a parole violator w/ a new term or just a parole violator??? he's been waiting more than 2 months to see his counselor right???

I have been in contact with his old counselor at Soledad several time. He is a nice man and even called me back a couple of times after I left messages. My son tried to just return there after his new sentence but unfortunately since he was officially paroled and has a NEW sentence they sent my son back to reception, this time at DVI. (last time San Quentin). He did get an 8 month sentence. The first offer from the county court was for more time but he refused and decided to take it to court and fight it. They did not have a very good case and wittnesses were not avaliable but I don't want to get into all that right now.....they last offer was for 8 months and he took it. He was in jail at Santa Clara County (Elmwood Facility) prior to that and as far as what the attorney told me he was going to get straight time for that. They have no jobs there or any special programs except for level one, minimum security. My son is level 2 at the state and so was in maximum at the county. It's sucked. He likes to work and keep busy and they had nothing for him there. Now he is in DVI in reception and has been there since mid September. He has not seen a counselor.
As far as people only getting an 8 month sentence I have talked to two other people who's sons had an even shorter time once they got to state. WHat should have happened is that the state and county should have figured out he had these other charges last year and sent him out then so that he could have served all the time concurrently, like many others I have talked to. Instead they seemed to have dropped the ball and waited until his sentence was up and then picked him up less that a week before his scheduled release. County also kept him too long because they "lost" or misplaced his file and I had to get the public defender in SC County to look into it and see why he was not moved sooner. Yes, I am aware it takes time to move inmates but all the others who were in court when he was were moved way before he was and the county still had him listed as having bail and a case that was pending...which it was NOT it had been settled!! They messed up. Now, he wonders why he has not seen a counsleor and is on his 6th new cellie since he has been there!! I guess with 176,000 inmates they just can't keep track of them all? An unhappy mom....:(

He got 16 months the first time....now he had to return. I am not going to second guess the courts but this time he has 8 months. 3 months in Alameda County, 3 months at San Quentin reception, 3 1/2 months at Soledad, 3 months in Santa Clara County and now he has been at DVI for about 2 months. He spends so much time in reception or orientation at each new place that I don't get many visits and little or no phone calls either. :mad:
