sherri13 06-24-2002, 01:55 PM CAN ANYONE TELL ME HOW GAIN TIME IS CALCULATED? HOW DO YOU FIGURE OUT WHAT THE EARLIETS POSSIBLE RELEASE DATE IS FOR SOMEONE? FOR INSTANCE IF THEY HAVE FOUR CONSECUTIVE SENTENCES FOR A MINIMUM OF 1 YR 6 MOS AND A MAX 1YEAR 10 MOS EACH--AND THEY HAVE A JOB AT THE PRISON HOW IS IT FIGURED> I AM VERY CONFUSED-
IF CONVICTED JUNE 19 2000 IT WOULD APPEAR THAT THE EARLIEST RELEASE DATE POSSIBLE WOULD BE IN 72 MONTHS -- BUT CAN IT BE EARLIER WITH GAIN TIME-IF SO, HOW MUCH EARLIER?

Shortie 06-24-2002, 06:09 PM sherri it depends on the state.. each system does these caulations different.. ant gets a flat 3 yrs off his sentance and as long as he is an s3 he will get an additional 5 days per month taken off.. that is all good time and work credits..
jdswifey02 06-24-2002, 06:18 PM in IL, there are like 4 different kinds of "good time" and the calculation and rules for each are really complicated... but me explaining even everything I understand wouldn't help you out much Sherri....

ALL I KNOW IS THAT WHEN BUTCH WAS LOCKED UP, HE WENT FROM A RELEASE DATE OF 11/2010 TO 12/2013.... SO, A BUNCH OF GAIN TIME WAS TAKEN FROM HIM....

BillnDenise 06-26-2002, 02:02 PM Sherri, sorry I can't help you. I just look up Billy's projected release date on the bop website. That's as involved as I get because he only has that one charge. He doesn't have anything else on him.

aprilcat 06-28-2002, 06:25 AM sherri ~ you probably need to talk to someone at the prison. my friend at wci is gaining time, but, because of WHEN he was convicted, he is not allowed to use it. however, he can still accumulate it in case the legislature changes its mind and allows gain time to be applied to sentences again. it's basically very confusing and depends on the crime and the conviction date, so i'd check with either someone at the prison or someone at the parole commission (http://www.doc.state.nc.us/parole/). good luck!!!! *hugs*

I AM GOING TO CALL HIS FACILITY AND FIND OUT WHAT I CAN-DONT THINK PAROLE WILL KNOW B/C WHEN HE GETS OUT HE IS STRAIGHT OUT, NO PAROLE-I KNOW ON NC DOC SITE HIS PROJECTED RELEASE DATE HAS MOVED UP 8 DAYS SO FAR

Iam sorry. What is the BOP website? Is that the same thing as Michigan's Offender Tracking Information System Website? Basically the DOC Website for your state? :)

I know where Tony is at (Tyrrell) in NC, he said that he can get so many days gain time for things like excessive heat, rain, etc. I think he said that he can get the max of 5 days per month. I checked the DOC and so far they haven't given him any gain time for the month of June. He thinks they were supposed to so I need to call and find out what's going on. Hope this helps a little!

The BOP website is for federal prisons and inmates. It gives the basic rules and regulations including an inmate lookup and addresses to all the federal prisons.
shalove 09-27-2002, 08:16 PM It varies state to state. I know here in WA state it is a 1/3 off your sentence. but there are bills being passed here all the time. i know they are talking about passing one for 1/2 time. shoot i wish. you can call doc for your state and talk to them about it.
Seekuout 10-06-2002, 04:10 PM Sherry...I believe it is 4 days per month. If they work in inclimate weather or over 95 degrees they get one day for each day worked. I'm pretty sure that's the way it goes. It can also change, if they have an infraction it will set them back and will have to wait and earn some time back. Hope this helps. I am in NC.
shalove 10-06-2002, 06:18 PM I KNOW IN WASHINGTON STATE DEPENDING ON THE CRIME AND YOUR OFFENSES FOR THE CRIME YOU CAN GET A 1/3 OFF FOR GOOD BEHAVIOR. BUT OF COURSE IF YOU GET AN INFRACTION YOU CAN GET THAT TAKEN AWAY YOU. THEN WHEN GOING TO WORK RELEASE YOU CAN GET UP TO 10 MORE DAYS TAKEN OFF FOR GOOD BEHAVIOR. BUT YOU JUST HAVE TO TALK TO SOMEONE THAT IS IN THE STATE THAT YOU ARE IN. EACH STATE IS DIFFEREN.... I WISH YOU MUCH LUCK AND HE GETS HOME SOON. GOOD LUCK TO THE BOTH OF YOU!!!

IT IS HARDER NOT TO EARN GAIN TIME.BUTCH LOST EVERY BIT OF HIS GAIN TIME FROM 2011 TO 2013 WHEN HE GOT THIS LAST WRITE UP AND WAS PUT IN SEG. I WENT TO THE WEB SITE AND SAW TODAY THAT THEY HAVE NOT GIVEN IT BACK TO HIM... SO, I GUESS HE HAS LOST 2 YEARS.
