I am looking for some info on 8.10 orders .... if you know anything about them. I believe the guys call it gating!!

I totally agree! I have been looking into and asking other forum leaders what we can do to get this place going. It drives me nuts, come in and check and theres no post. Any ideas , anything you want to add. I was thinking of some news articles and stuff. Just let me know!!

oh yeah and the part of being new, dont worry I dont understand it all either. THis 8.10 is like an extra 1 to 5 years parole after they have serverd all the sentence. Which is technically there warrant expiry date. But somehow they stick this order on them and they have all kinds of stupid stipulations. I believe it is only for viloent offenders and sexual offenders. I am still trying to figure it out. Gage has been in contact with a lawyer regarding this too. I just havent heard back yet from him....:(

I may be totally wrong but some reasons that are possible for the Canadian
"apathy" is that their system is more humane than ours here in the USA.
Also they do not have capital punishment....and then of course, Canadian have a (unfair?) reputation for apathy

Just my 2 cents worth.

steveboo23 i think articles are good new paper stuff even live chats for people in canda are good. i will ask my bro about this 8.10 thing hes out of prison now but im sure back in soon as see what he has to say about it. if you need any help getting it up and running im just a pm away.

Hi - well Darren said basically the same as above, it's like another few years being tacked on after the end of the warrant expiry - "enhanced sentencing..." -
they can continue to enforce conditions and even reincarcerate... just like parole.
It's a really arbitrary thing, seems to depend on the individual cases.

I only saw your post now so sorry for the delayed response Titantoo - I would say Canadians are more reserved generally than Americans but certainly not apathetic. We do have strong views and opinions but we usually tend to keep them to ourselves. I do agree, however, that our prison system is more humane although certainly far from perfect.

As I understand the 8.10 orders, they are required by law to give the offender notice well in advance of the hearing during which CSC will make an application for gating. The offender would then have the opportunity to respond and, by extension, to have legal representation. This is not a surprise thing and should not be tolerated if CSC tries. The statute you need to refer to is the Corrections and Conditional Release Act which should be available at your local library or, alternately, on the Internet. By the way, any serious concerns an offender has relating to conduct of CSC employees/management, you should refer to the Office of the Correctional Investigator in Ottawa. For provincial offenders, the Office of the Ombudsman may be of assistance although I have very little confidence in their ability and/or willingness to seriously address issues raised by offenders. Try them anyway. Better than nothing, although not much...LOL
