Hello, does anyone no what happens to the spouses of a prisoner. We live on base and I will be facing a court martial soon. Is my wife forced to move out of base housing during confinment? Even if the confinement time is done at this base? Also what about medical benifits? Are those teminated or does she still have the right to see the military doctors. Please give me any information you can. THANKS

hi moses,
from what i've heard (i'm not a spouse), since you have a family you support, your wife would probably be able to receive your paychecks for 6 months. as far as housing goes, i don't know. someone in charge of your confinement will probalby tell you. i believe she will continue to get military (health) benefits, but i'm not sure. you could contact your JAG office maybe?

i believe it would depend on the type of punishment you would/could receive at court-martial: some take away all pay and allowances, others have just had to pay a fine, but still receive benefits, so you wont really know that until you are done. but as skm7776 said, your wife will still get to keep her id and get health benefits, until you are out of the military or have finished your appeals, whichever is longer.

It depends on if you are considered as no longer "active duty". My husband is still considered as such and so our daughter and I still can live on post if we wish, and have benefits such as tricare. As for the pay issue, I believe that is based on dependents. Hope this helps you some.

As far as pay is concered in my case my daughter was the victim so we do get victims comp for two years and we also recieve medical for that lenght of time. We have been very lucky. We were not able to stay on post once he was conviced. I do not know in your case if you wife is not the vicitm I am not sure what they allow. I am also not sure with you serving time on the base if that makes much of a difference my ex-husband was sent to Ft. Leavenworth to serve 27 years. I hope the best for you.
