View Full Version : Voluntary and Involuntary Out of State Transfers

Today the governor declared a state of emergency in CDCR and ordered the Secretary to immediately begin transfering inmates to out of state prisons. First will be volunteers, and if not enough volunteer, involuntary transfers. In his declaration, he gives criteria for the involuntary transfers. The Secretary will have to develop contracts and comply with the interstate compacts. Sorry I can not post the Declaration from the Governors website, but I am not that computer literate. To read the Declaration ( and criteria) go to the governors website and in the Advanced Search box type in " prison transfers" .The delaration is the top document, dated today.

Thanks so much for finding this!! I just read through both the declaration itself and the summary...and I honestly don't think any of us should panic just yet about this. First of all, it says they're looking to transfer 2,000-5,000 inmates. While that sounds like a lot, there are over 170,000 inmates in prison. I would even be willing to guess that there are 2000-5000 people who would voluntarily transfer out of CA anyway.

With the reality that most prisons are operating at close to double their designed capacity, a move like this sounds much more like a pre-election move than anything else. Moving even 5000 out of 170,000+ will not solve the overcrowding problem. So far the only thing I've heard Angelides say he'd do about the prison system is that he'd declare a state of emergency--this may just be Arnold jumping the gun and getting there first. We all know how this game works, and that often things like this are announced that never even happen. So I urge everyone to stay calm, read the information that's out there, and take it one day at a time. Here are links to the information online that JLS mentioned above:

Thank you for posting this does anyone know when they will begin to start the transfers? My fiance filled his survey out saying yes he would transfer but then after thinking about it doesn't really want to, are they going off those survey's??

According to tomorrows Sacramento Bee, they will start within a month. The CDCR is signing contracts with private prisons in Oklahoma,Arizona, Indiana, and Tennessee.

I am very concerned about this. I live in mississippi while my man is in cali. However he would be interested in transfer to mississippi however someone has told me that mississippi isnt accepting transfers. Is there a way that i can find out if they are and also find out the story on lifers in another state. The states around me that are looking at accepting transfers are TN, AL, LA, OK tennessee is the logical choice since i only live 50 miles from the tennessee border at memphis. If anyone can give me a link to another person on the forum that can help me I would certainly appreciate it.

According to the press release/proclamation, the following states are being discussed: Arizona, New Mexico, Oklahoma, Oregon, Indiana, Michigan, Louisiana, Tennessee and Alabama. I unfortunately can't help you with any information about prison and conditions for lifers in those states, but there are forums for each state on PTO, so you might want to try posting your questions there.

Yes, I heard this too on the radio this morning. Certain DJ's find it amusing. I am glad you posted this, I was wondering what the determining factors are for the transfers. Thank You!

I read that they say there is 20 000 inmates that will voluntarily transfer so they don't think they will have to do involuntary transfers. They also said that if they had to they would start with the people who would be deported after their sentence to be transfered first.

The transfers will be to private prisons, not the state facilities. In all likelihood, the transfers will be level I and level II inmates. The same private prisons operate in California and those are the only inmates the private prisons will take. I doubt lifers will be leaving California, because there are too many issues ( parole hearings, on going appeals, etc. ).

When I first heard of this I thought it would be illegal. This seems crazy but when I read it, it made more sense. Thanks Ladies for the Info!

Go to the Califoria Department of corrections web site, go to commications and check it gives a list of 23 out of state prisons willing to accept those from here.

I put a thread out there to Illinois to see whats up with their prisons, my reply was they didn't know anything about this AND they said their prisons are busting at the seams. I wonder how many other states are like this??

All of the State run prisons are full, in vitually all the states. The inmates are going to private prisons in other state. CCA , Cornel corp., and GEO are all getting contracts to house California inmates. There is a new 1200 bed facility in Indiana that is recruiting staff now per an article in the Sac Bee.
