Finally... considerations are being made
BUT, how many of the "mentally challenged" has the state of Texas murdered?

The above is the case that defined no more "mentally challenged" shall be put to death.

The question is, will Texas find a way around this ruling and still execute anyway?

Joy,

This was set at the federal level so, for the time being, Texas will have no choice but to comply.
It will be interesting to see who is first to try and "buck" the supreme court. I'm not sure how things work at this level, if they have an appeal process or not. It's bound to cause a lot of controversy.

this was in the Dutch newspaper too.they ended the article with the sentence that many death row inmates will try to prove they are mentally incapable....still it made me kinda happy

MAKES ME WONDER IF A LOT OF PEOPLE WHO SHOOULD TEST MILDLY MENTALLY RETARDED WILL START TESTING BORDERLINE INTELLECTUAL FUNCTIONING BY DOC PSYCHOLOGISTS.

Sherri,
Currently in Texas the standard to meet is an IQ of 70-
With a +/- variance, depending on who and why, this might very well be manipulated.

MY EXPECTATION IS THAT IT WILL BE CHALLENGED AND MANIPULATED- THE TESTS THAT ARE GIVEN TO DETERMINE IQ LEVEL WILL BE QUESTIONED AS NO TESTING IS 100% ACCURATE- MY GUESS IS OTHER TESTING INSTRUMENTS AND "TESTERS" WILL BE USED TO MANIPULATE SCORES AND GET THE OUTCOME THEY WANT-

I HOPE I AM WRONG

Sherri, I also hope that you are wrong, but I seriously doubt it :(
