Does anyone know of a Canadian incarcerated in the United States that is going through the process of a transfer? I read some where that since the treaty came into effeect, only about 1000 people have been transfered from the States back to Canada. As well, can probation be completed back in Canada if handed out in the States? I've heard that it can, but I am not really sure where I heard that either. As well, do Canadians only serve 66% of their sentence? Please let me know if there is any information that can be shared about these questions. Thanks!

Canadians, for the most part, can get out after 1/3 on early release (there are usually tons of conditions assigned to that, even checking in every day at the local police department might be one). Most Canadians get out after 2/3, but I'm not entirely sure if they are paroled, or just released. I was paroled after 1/3 on early release with only a few conditions, and after 2/3, off free. I also only served a sentence in DAYS at the county jail in my city.

Just so you know, County sucks. I didn't even get yard time, I was in the common room or my cell all the time, 24/7. It sucks bad if it's less than a 45 day sentence in Quebec, but it's over quickly. No visits, but I could make phone calls. I wasn't permitted any property because I had no one who could bring it to me.

It is much easier to transfer if your doing Federal time in the US, as opposed to a State sentence. If your application to the US Dept of Justice is approved, the entire (Federal) process takes about 8 months. Prisoners transfer from Ray Brook, NY by bus to Milhaven reception 4 times per year.
From Milhaven, inmates are assessed.
If your transfer is approved, your USA sentence becomes a Canadian sentence. If you are a first time federal offender, with non violent charges, you will usually be released to a halfway house after serving 1/6 of your sentence. As it takes at least 8 months for the transfer, many arriving inmates are released to the street within 2 weeks of their arrival.
Canada also has scheduled cross Canada flights every 3 months, and inmates are returned to their home institutions. If for example you live in Vancouver and your release is in two weeks, they'll give you an airline ticket, and a bus ticket for the ride to the airport.
If for example you are sentence to State time, you must first apply to the Board of Prison Terms in that State, that takes 8 months and permission is hard to come by. If approved, then you apply to the Dept. of Justice and Canada.
Note: In Canada, a first time Federal Offender is giving every opportunity for early release, returning from the USA makes you a first time offender in Canada, so if your going to be involved in crime please note, that a second time offender in the Federal system will have a much harder time gaining release - especially in Ontario.

My sister is a Canadian citizen and is serving a 57 month sentence in CA. Prior to getting sentenced, she entered into a plea agreement with the DA which states that if she pleas guilty and cooperates with the authorities, that the the prosecutor will allow her to get transfered back to Canada. Also, the prosecutor said that they will file a rule 35 (which is a motion to reduce her sentence- I'm really unsure of the details of this motion). She has been incarcerated for a little over a year now and she is still waiting for the sentence reduction. She would like to proceed with the prison transfer, but she's scared that she's gonna be denied and would not be able to re-apply for 2 years. What is the likelihood that she's going to get approved for the transfer to Canada. She has no prior conviction, her crime was non-violent. I really would like to have my sister back home. HELP!!!!!
