View Full Version : Need for Understanding Fed Point System:

Hello all. Could someone please help me to understand the Fed Point System? My girlfriend got caught up in a real mess with her ex boyfriend last year. She's had about 8 or 9 different charges leveled at her. There's a gun charge, intimidation of a witness, conspiracy to manufacture, and distribute meth, trafficking. Maybe some others. She was not even living there at the time. She had a few of her clothes there, and because her boyfriend had no phone, she allowed him to get the service connected in her name. When the warrents were served, she was out in the yard trying to get her car started. The house was locked up. The feds served the warrent found some chemicals, and a hand gun. The report said it was in arms reach when the warrent was served. She's out side, doors are locked, hand gun was under a mattress in a locked bedroom. Anyway! Her public defender is not telling her anything. Both her, and I would like to know what she may be facing as far as the time, because of the points. She is a first time offender. She thinks that because she was charged with so many charges, that the feds will use some of them to get her to cop a plea. Can anyone tell me what she may be facing? Please I need to understand this, and get some kind of ideal how many years she may be looking at.

1st off Id like to welcome you to pto!! You will find a wealth of information here, and alot of warm, caring people to help you get through what I am sure is a very difficult time for you.
With drug crimes there are mandatory minimums that you can find on the dea website. As for the point level, they are located in the us sentencing guidelines. Ill try to get you a link, and post it here. There are alot of different factors to consider thugh, such as if she had a minimum role, or if she was in a management position. The gun can add five years, it depends on how they decide to charge her, or what plea they offer her. The fact that this is her first offense does help, as she wont get points added for career offender. Thanks so much beverlywu. This will help us alot. I appreciate your assistance with this. As of yet. I don't have the access to her paper work. Together her, and I are working on getting her court appointed attorney to get me a copy of the charges. The attorney seems to be dragging his feet in getting me the information. I'm trying to get the money together to get an attorney who will fight for his client. I guess I must have been dreaming when I thought I once heard the words equal justise for all under the law.
Once I get the information, I'll pm you with it. If's still okay to do so.
