HI,

For those of you that havent read my previous posts, my husband is down for 3 years on a 1st dgr Forgery charge. He got his TPM about 2 weeks ago. His Max date was set for 12-05 and his TPM is 2-05. Thats 26 months on a 36 month charge!

He got his grid sheet today and its all wrong. They have him at a level 3 crime....should be level 2. They have him as not being employed 6 months prior to arrest...also bogus. They also have the number of times he has been incarcerated wrong!! He filed an appeal with the help of his counselor. The counselor was very helpful (Praise the Lord) and advised him that he should get a better out come. He's already been down for 11 months (as of tomorrow). We were expecting 18 months according to the grid and the 26 months was a shocker!

Anyone else have issues such as this?? I have looked on the GDC website numerous times and it seems that they cannot be following any type of "grid" because I have seen people with a 5 year sentence and previous convictions only serving 6-10 months. I really dont understand how they are really figuring things up fairly. Could be all the corruption I have read about lately.

Just thought I'd make everyone aware to double check the grid for accuracy and to appeal if it is wrong. The inmate has 30 days after getting the grid to file a formal appeal.

Hi I read your post and was wondering if there was any way of knowing how long my fiance will do. Is there a certain website I can go to that will tell me that ? What is GDC? I would greatly appreciate any help I can get from anyone.

HI

GDC is Georgia Department of Corrections. There is not a place to see a grid but when my husband sends me his, maybe you can figure out what the grid time would be.

It asks different questions like:
Was the offender employed for 6 months prior to arrest?
How many times has offender been incarcerated prior to this term?
Each answer is graded by points the total points is where they figure up the amount of time to be served. Of course violent crimes will do 80% no matter what and there wont be a grid. Grids are for sentances OVER 2 years. Anything less than 2 years is to their discretion. Hope that helped. As I said, I will get the grid sometime next week and maybe can send you a list of questions for you to determine what his time frame is. Like I said it wont work for a violent crime because you are gonna do 80 % (burglary is also considered violent)

Darlene, did you speak with anyone at the parole Board? Also if any way possible you should attend the Families of prisoners meeting in Milledgville tomorrow. They won't address parole issues but it may help. I am fighting a wrong max date that my wife was given. They are not giving her any credit for time she spent in Chatham Co. jail even though the judge gave her credit for time derved. That is 5 months.

Ok I'm sorry I cannot attend but I did read a good article in the AJC today that mentioned the meeting.

As far as the incorrect max out date.....This is what I understand when it comes to the jail time. First of all, do you have the paperwork that supports the judge's decison to count the time? If so, this needs to be sent to the DOC. They are the ones who adjust her time NOT the parole board.

Secondly, has she gotten a grid sheet to compute her time?

If she has gotten a grid sheet then she has 30 days to appeal the decison if there is any thing incorrect about it.

Now when you say incorrect max out date....how much was it different? The 5 months? Are they asking she max out? On the grid sheet it gives a "pick" or early release month if she is a good inmate and has no problems and according to my husband (info from other inmates) the pick month does work.

Please explain if you can and I'll try and help you with what I can.

Check out my post which explains the Grid sheet and the factors determining points. I just got it today and it should help you figure out how many months to serve that she should get.

Darlene, no they are not asking her to max out'this is her first incarceration and yes at the meetting I showed them where the judge said she would get credit for time served. I hope that this is all close to being resolved.

Hi Darlene, I would be so grateful if you could send me a list of questions that are asked on a grid... I am just dying to get some kind of information on a possible parole month or release date for my fiance.
