I've been posting a lot of questions
For anyone who has had to deal with INS while in federal prison, can you tell me when they decide if they will deport him or not. He'll be in prison for 5 years. I'm just wondering if they decide on his deportation status early on while he is still in prison or do they decide that only when his release date approaches?
I'm asking because I would hate to have him spend his whole sentence and THEN spend MORE time waiting for them to decide what to do with him?
What are your experiences with INS and their time frame in getting things done?
Maybe I will try to contact the INS and see what their procedures are

The Institutional Removal Program is an attempt to accelerate deportation procedures for foreigners. You may find details in this site:

My son. Argentinean citizen has been told by counselors and his defender, that the procedure will take one to three weeks after the end of his sentence, and he will be held at an INS detention center during that time. We know of other cases and the time is similar in fact. However each case may be different considering recidivism, other pending processes or pending appeals.

INS usually interview them a few months before his release date and will inform the inmate if they have an INS hold. He will be release to INS and have to go through a removal or deportation proceeding. A very close friend of mine is detained at INS Detention Center in Lancaster since May. INS picked him up from the Men's Central Jail and after 1 1/2 weeks, had his hearing with the immigration judge and told him that he will be deported. He is appealing his case because his lawyer misrepresent him and didn't inform him of the immigration consequences if he accepted the plea bargain or get convicted with his case. His new lawyer is appealing his case for the 2nd time and it doesn't look good because he got convicted of possession and intent to sell of meth. Immigration judges will not give you the time of day when it is a drug related offense and METH. The judge allowed my friend to hug and kiss his 2 kids without his handcuffs, like it was telling him to say his goodbyes. Very emotional and heart breaking to see his kids in tears and hug him tightly and don't want to let go. Anyways, did you consult any immigration lawyer? I think it would be best if you do so your questions will be answered. Good luck to you and hang in there.

i have a brother that is in states prison with only months left to complete his sentence for grand larceny they moved him to another state prison a level 2 when he was a level 1
the ins has issued a detainer on him but know one has came to talk to him yet. i wander if i can file a cancellation of removal on his behalf or do i wait untill ins talks talks to him. thanks julie
