My husband has served 9 weeks of a 12 mo 1 day sentence in a federal prison camp. Does anyone have any experience with getting home confinement for 1/2 of the sentence? Fedman pointed out to me where it discusses this in the sentencing guidelines, but I don't know how one goes about getting this. Our lawyer was useless. I guess I just need to consult a new attorney? Any advice would be appreciated. We have 2 small children whom my husband stayed home with the last 2 years. Thanks!

I hope I was of some help. I am not sure how one goes about this after the fact. Your attorney should have requested this at sentencing due to family circumstances. Hopefully someone can help you out with info on how to get him out early. Good Luck
Our attorney was useless too... in the end our judge ordered 1/3 of my husbands sentence (18 mos) to be served as home confinement, partly due to the fact that I am ill. He was sentenced to 1 year and 1 day in FPC also, will have 54 days of good time and 10% of sentence in halfway house which will mean approx 9-10 mos actually served in prison. I have heard of plenty of rumors about doing something because of overcrowding at all the prisons, but at this time that is all that they are...rumors.
Until the day comes that they say you are going home, not getting my hopes up
