I have a question, My fiance will be sentenced June 16th to 3.5 flat bid. the judge, ADA and our lawyer all want a Violent Felony Override.....how does DOC figure in with this? Will they pretty much go through with what all the others agreed on. His PSI is flawless, this is his first offense and yes it was Robbery 2nd Class B but no waepon and no injury at all.
Any info would be appreciated. Also, a few people seem to think he will go downstate for reception. We are in Rochester NY. Any thoughts.

I am not really sure of your question ? Did he apply for a VFO?
He will most likely go to Downstate but you can never tell with the NYSDOC.

A VFO is applied for after the fact as much as I know--sometime after they get in the DOCS system-never heard of one granted before they go in-but they need to have all their agreement documented in his file-so when the time comes it is there.
He will go to Elmira for reception most likely (like 99%). Nearly all upstaters go to Elmira.

Elmira is also a Reception Facility and closer to Rochester than Downstate, so it is possible that he will go there first for processing.

Julie3340, I assume that your husband is already @ reception (judging by date), but I tihnk it depends on space available.
I was arrested in Roch, but went to Ulster for reception. Meanwhile, my co-defendant was in Elmira.
