tonietee 05-18-2006, 03:56 PM Okay I have a question, Mikeie my boyfriend, was violated on absconding...for 8 months (I think he is irresponsible...)anyway he has no new charges, wasn't dirty (for drugs)or anything, he just did not check in. His parole officer is wanting to give him the full year....for absconding. So anyway what possibilities does he have for less than a year's time? Does he have a chance (here in CA, mind you)? I am hoping he will go in front of the parole board and let them see that he has no new charges, and that they will give him a break...however I understand absconding is absconding...I am not one to want to go back in to the system so why anyone would abscond is beyond my understanding, if you do not like Prison (or jail) stop going back. Thanks for any input.

NuBeginning 05-22-2006, 12:44 AM More than likely he'll give him the year, but he'll only end up doing 6 - 10 months depending if they give him half-time or 85%.
Gryphon 05-22-2006, 09:21 PM 8 mos. AWOL will get him 10-12 months. He might NOT get half time if the original charges were serious enough. He will get half time for run of the mill felonies.

pbertgod 05-27-2006, 06:17 PM my husband absconded for 8 months as well and got turned in by someone we know, he has only drug charges, he didnt get any new changes either, and the worst he could have gotten was 1 year flat, but they only gave him 7months with 1/2 so he only got 105 days, now were down to 51 days left, so good luck
shootna45 05-28-2006, 01:00 AM my bf did not report to his PO after getting out in Dec. She requested a year and said nothing but negative things about him in her report including that he was a career criminal, will never change and will abscond again. He was first offered 8 months at half and took 6 months at half and gets out next Sunday. Tell him to refuse the first offer no matter what as he will almost always be offered less when he goes in front of the board.

pbertgod 05-28-2006, 07:44 PM they offered my husband 9 with half and he was like i know i absconded but damn this was the first time i actaully had my shit together got married, had a job, having a baby in sept. and your gunna give me 9 with half come on, so she went into her little office and came back out and said ok ill offer you 7 with half and he took it, and then he never had to go in front of the board, so good luck
pbertgod 05-28-2006, 07:47 PM but my husbands last time in before this he did get a year flat for absconding but he only managed to stay out of prison for 28days and got busted on the streets, and this time he managed to stay out for like 10 months and abconded for 8 and after he mentioned all that he had going for him it helped him out time wise, so all depends i guess, thank god my husband gets out in july and gets off parole for good 7 months later, he'll do it this time too cuz he'll have a baby and a wife, well he better do it haha,

ok, i read the part in red as its own statement. 12 years in, no wonder he nows my bf. They have probably done time together several times before this one. LOL, losers!! LMAO!! Only 4 days until my loser steps!!! Yea me!!

JJFloyd 07-12-2006, 04:26 PM Well my husband adsconded the first time for 4 years and did 4 months the second time he adsconded for 5 years they gave him 9 months but he only had to do 6 months I think it really depends on the mood of the people making him the offer because sometimes we never know what they are going to offer... but keep your head up and stay strong...he'll be home before you know it..trust me I know its hard...

ESQUIRE 08-05-2006, 11:33 PM I am an attorney and all I do is parole revocation matters.
BPH guidelines for absconding are 5-9 months eligible. If the committment offense makes him ineligible - then he will be doing flat time.
First thing a DC (deputy commissioner) will do is look at the committment offense to see if he is dangerous. Next - is this his first, second, third, etc absond. The system is punitive so don't expect to get less time for your second abscond.
He will be assigned an attorney. They will have an interview where there should be an initial offer by the Board -- and he will go to a probable cause hearing the next day or two. At the PCH - DC will determine if there is probable cause to hold him. At that point, there will be an opportunity to try and negotiate the case. Most cases are resolved at the PCH stage - and since this is a simple abscond - it should resolve... unless there is an unreasonable DC.
Many parole officers was the MAX - but it is laughable especially on a first violation.

You are right. But what you are reading in this post is to the original post, about her loved one obsconding. YOUR question was about your son being violated for being in the wrong place at the wrong time. I gave you an answer as to a similar situation from your son's.
Did you want to ask aother question and see if any of us here can help you out??

SALS LADY 08-16-2006, 02:27 AM Sometimes it really just matters to who you are and your record, the board and your attorney, My husband has several abscounding's in his past, he just got out in Nov 2005. after doing 3 yrs. Caught another one in June 2006, got 6 mos with half he'll be out in Sept 2006 Thank god he only got the 90 days.

My BF is in SQ for abscounding. I know it is not his first time. I dont really know how many times he has done it. I only know about two cause we got together after his last one and he was abscounding for four years before he got caught up this time. He was given 9 months with half time so he should be home in about 3 months. He was given the same amount last time and was only out for less than a year that time, but this time he went in clean and sober something he has never done in the past. I am sure that might of helped him a little. I am just really hating it cause he is going to spend that whole time in recp. which means no phone calls or anything and with me stuck here in NY i cant even go and visit him. We are both from Sonoma County and if it wasnt for the fact that he was homesick and wanted to go back there we would still be together right now. He knew his chances of being caught were high if he went back but he did it anyway. Now we both have to suffer for his mistakes.
MikesSis 11-26-2006, 09:09 PM My husband always abscounded, the one time I remember that the only thing he got picked up for was abscounding (not dirty, no new charges) they gave him 6 months with 1/2 time, he ended up doing 121 days since he did not get 1/2 time when he was in county.
