My husband will be coming home :D in a few weeks on probation. He was a stay at home dad(3 kids), and going to college, when he was arrested. will he be required to get employment to stay on probation?
Any help would be really appreciated. Thanks!

Check his conditions of probation.... I believe he has to be either employed or going to school. However, unlike most other states they don't really mandate that person has to be employed unless they make it a "special condition"

Thank you very much for the response. He's coming out of Orange county, and they haven't been too helpful with answers. I know it won't be a special condition, but was just wondering if they expect it. Thanks again!

Being in Orange County, I think they expect it but since he was a stay at home dad and student prior to his arrest, I would imagine that they would be ok with him continuing that path. Just make sure and tell his probation officer what the situation is and I bet everything will be fine. By the way, this is only speculation based on how OC seems to work. Good Luck!!

If he doesn't already have a copy, he needs the courts orders placing him on probation. These will include all terms to be complied with. A standard term in most probation grants is to "seek and maintain gainful employment". See if that box is checked. You can get a copy of the orders from the court file, the probation dept., and perhaps the defense lawyer.
If it is checked, he'll need a court date to modify the terms of his probation. He should speak to his PO before that hearing in teh hope of getting the PO's blessing. The Judge will want to know how he'll be supporting himself and his family if he's unemployed; and why he can't work and still get some daycare. TO get a court date, he can contact the attorney who previously represented him; and in some counties the PO can add modifications to the calendar.
