Hello everyone, I need some help or advise. My fiance and the father of my daughter, has just been arrested for illegal re-entry after being deported. He has been in the united states since 1969 when he was a month old. In 1994 he was convicted of possion with intent to sell and deported voluntarily. Illegally Re-entred and order deported in 1996 after serving a state parole violation for the state conviction. In 2002 illegally re-entered again and sent to serve a state parole violation for the second time. Now he is in custody again for the illegal re-entry. Is there anything i can do, is there any law that can help him? He has no family in mexico they are all in the united states, he has four children born here whom he pays child support for. Is there anything that can be done? And another thing what is the worst case scenario in this type of situation? I know that being federally indited is a possibllity, however what are the sentence guildlines and are there ways to get them lessened? Please help me. Oh ya and does Reagan's law apply to him since his been here since 1969?

His sentencing will be based on the deportation order he signed in 1996. Illegal re-entry holds anything up to 20 years however most of the convictions I have seen are 77 months. That means he will serve 5 years. That is the worst case senerio. If they prosecute. Unfortunately the INS does not consider his children and family being in the US an issue.
