APPELLATE COURT OVERTURNS DEA BAN ON HEMP IN FOOD

In a 2-1 ruling by a panel of the 9th U.S. Circuit Court of Appeals on Monday, the U.S. Drug Enforcement Administration (DEA) ban on the sale of food containing hemp was overturned. The Court ruled that the agency violated the federal administrative procedures act by failing
to give enough advance warning or allow for public comment before imposing the ban in October 2001.

Last year the Ninth Circuit Court granted the hemp industry's Motion to Stay the U.S. Drug Enforcement Administration's "Final Rule," which would have banned the sale of hemp foods containing trace amounts of naturally-occurring THC under the Controlled Substances Act (CSA) of 1970. The DEA declared that hemp food products intended
for human consumption be banned under the Controlled Substances Act because some products contain tetrahydrocannabinol - the psychoactive chemical known as THC that is found in marijuana - and may get
consumers high. Advocates deny this claim, saying that hemp contains such small amounts of the active ingredient in marijuana that it is not possible to become intoxicated.

Earlier this year the DEA issued a similar ban, this time following the administrative procedures, and is now being sued by the hemp industry. The case is pending before the appellate court and the ban has been put on hold.
