My Boyfriend Is On Federal And State Parole And He Recently Gave Dirty Drug Tests.he Was Sent To County Jail And Then Shipped To Prison. What Is The Maximum Time He Will Have To Serve??

HI, I DON'T KNOW IF ITS DIRRERENT FROM PLACE TO PLACE. BUT MY BOYFRIEND IA ALSO SERVING TIME IN PRISON FOR A VIOLATION, AND THE WAY IT WORKED OUT WAS HW HAD TO DO THE REMAINING TIME ORIGINAL SENTENCED. HE HAD 3 YEAR JOINT SUSPENED , DID 7 MONTHS BEFORE IN COUNTY ON IT. SO HIS VIOLATION IS FOR 2 YEARS, WITH 1 YEAR CREDIT FOR TIME SERVED. SO COMES OUT TO BE 8 MONTHS STATE TIME .(80 %-GOOD TIME.

Different situation. You are talking about what happened on a probation violation where there was a suspended CDC term and local credits previously earned. Parole violations (the original question) are handled very differently.
However, given the numbers you provided (3 yrs. suspended), that isn't a strike case. If non-violent, then teh crime should allow 50% credits. If violent, teh inmate ony gets 15% credits (so do 85%). The 80% number you quote should only apply to a strikes case; and I know this wasn't a strikes case because a strike doubles the sentence and there's no crime that carries 18 mos. CDC as part of the sentence triad. It could be 16 mos. or 2 yrs., but there's no way to mathematically achieve 18 mos. Something does not compute.


Yes, on a State parole violation, the max is 1 yr. without good time (aka "flat"). The length time on parole can be extended as well. The Feds can violae parole as well, and that may be on top of what the state decides to do. If the Federal violation is serious enough, then the state case might not add additional time.
The average run of the mill parole violation when teh Parole folks aren't too cranky seems to be 10 mos. with 50% credits.

scott was put in for a parole violation was caught in oct, sent to county jail then sent to wasco state p in dec from there they told him he would get 9months, he gets out in july, they sent him to PVSP after wasco in february. good luck and keep your head up

My husband got a parole violation, he was placed in custody with a hold . So he got a screening 14 days after he went in and they offered him 12 months flat, he plead not guilty and went to board. He was given a date to see board so in the mean time we had gotten letters from his employer and he spoke to a member of the BPT and explained what he did and how he was violated, she immediatly released him. The whole process took 36 days, so just be patient. I feel that it's worth it to go in front of theboard so that you can plead your case and see if they will cut your lienancy from 12 months down to time served, or a few months.

My husband received 2 years on a P.V. with good time he got 18 mos. but the judge had different presumptives to go on, the most was 3 years. That would have killed his sentance completely. They can send you back and have you finish your sentence out. At least in Arizona.

In CA., 12 months flat time is the max, unless they revoke your parole altogether, which is actually pretty tough to do. Meaning you have to have gone WAAAAAY over the line. And usually you will have gotten yourself a new case anyway. I don't know how the Federal time adds up, but on dirty tests, in my experience it's been no more than a few months....3-4 actually in. I agree that it's almost always better to go before the Board. Especially since the only "deal" they seem to offer at screening is 12 flat, which is the worst they can do anyway.
