Daveswife 02-24-2006, 09:15 PM Well I guess he has a court date here in WV finally. Of course no one knew about it (even his lawyer.) He called me a little while ago and he's less than 5 miles from me, but I can't see him. Visitation is tomorrow and he won't be in for over 24 hrs yet, so I can't go.
They use AT&T and I haven't had the money to pay Verizon so he's blocked. Somehow he got a hold of a cell phone and called me to let me know. He has no money, nothing with him and I'm broke! Plus I have to make an emergency dentist appt cause one of my front teeth chipped last night.
Sometimes I wonder what I did in my past lives. LOL. No one could have been that bad! Geeeeeezzzzzz!!! If I could get just ONE LOUSY BREAK already! Ya know?!

Is he in a regional jail? Does his DOC stuff transfer over? Will he go back to VA after this court date? Am I asking too many questions?

Yes, No, Yes, No! LOL. He's only here for court and then he'll go back and finish his sentence. The good thing is that he's also serving his sent. for here as well (at the same time), so depending on how much time they give him he may be finished when the VA sent is over. ***crossing my fingers, legs, eyes and...ummm well anything that can be crossed***

Daveswife 02-27-2006, 02:01 PM Thanks dw. I talked to his lawyer today. He had no clue of course! They will set an arraignment date and then a trial date. He will be here indefinitely at this point. Bright side is I get to visit without getting up at 2am and driving 3 1/2 hrs each way. At least for a few visits :D
Now I'm just gonna pace until I get the dates. LOL.
Thats got to be bitter sweet knowing he is only 5 miles away compared to where he was. I know that when Chris was only 13 miles away there was some peace knowing he wasnt far. Even when I couldnt see him I knew he wasnt far from me.

Why yes it snowed today, how in the world did ya guess? LOL. And it will probably be sunny as can be the day they take him back down there. *SIGH*

As I'm tearin him a new a** for making $700 worth of calls in one month...he informs me that if he's convicted here in WV he faces the 3 strike rule in VA...which for those of you who don't know means he'll spend the rest of his life in prison. So now that I've eaten half a pan of fudge brownies I'm kinda numb.
But hey...on the bright side I got that damn tooth fixed so I could eat the flippin brownies. LOL.
Could somebody just shoot me now?

Seriously, I am so anguished for you. Doesn't the 3 strikes rule apply only in VA? Wouldn't the WV one be separate? I have no idea how these things work, but I have to keep looking for that durn silver lining. (((((((HUGS)))))))

The longer the trial takes to be set the more I can see him and more money I can save. :thumbsup: It's not contact visit, but I can do without to save this much money!! LOL

Daveswife 03-06-2006, 06:44 PM Well, it looks like he's gonna be here until June 22 at least. That was the date set for his trial.
I wish his lawyer sounded more optimistic, but... I guess we'll have to wait and see what comes. I think he is going to try to get the prosecutor to accept a lesser plea. I hope she takes it.
The judge really shocked me though. He was soooo nice and polite to everyone. He even thanked my husband for being there. :eek: LOL. Like he had a choice. ;)
Any way. I'm just hoping this is over soon. June seems a million years away for some reason. At least I can keep getting the cheaper calls for now. Yea!

barb-k 03-07-2006, 04:44 AM Glad to hear that hes closer to home and the phone calls are cheaper. Can you research the 3 strikes rule in Virginia to determine if they use charges from other states? Also can you check to see if he can serve the sentence in your state instead of Virginia? Maybe he can be closer to home for part of his sentence.
